LAKE ELMO CITY COUNCIL MINUTES JULY 17, 1990 <br />Mayor Dunn closed the Public Bearing at 8:06 p.m. <br />M/S/P Armstrong/Hunt - to grant a variance for lot <br />Agricultural Zoning District to Ray Salus, 404 Lake <br />on the following Findings: (Motion carried 3-0). <br />(1) There was originally 40 acres. <br />PAGE 5 <br />size in <br />Elmo Avenue, based <br />(2) 14+ acres were taken by condemnation for the Northern Route <br />of I-94. <br />(3) This reduction in size was not the result of applicant's <br />actions. <br />(4) That taken land is still open space today and would be if <br />Mr. Salus continued to own it. (Mr. Salus still farms the <br />taken land for the current owner.) <br />(5) This is an unique application. The proposed use is not intense <br />and the amount of acres required is not the same as the amount <br />of space which would be required for buildings or other <br />impervious surfaces that we might see for a housing development <br />or an intense commercial development. The intent is to convert <br />open farm land to an open space driving range. The full 40 <br />acres would not be required for actual use, but rather to make <br />tap the 1 house per 40 acres rule in Ag zoning now in effect <br />for the City. This is a downzone to AG. This land has always <br />been in Agricultural use and the proposed use won't change the <br />open space by much. <br />(6) This application is also unique in that it is farm land <br />surrounded by General Business, Alternative Ag Use <br />businessess, the Cimarron housing development and a golf <br />course. This application would not be deleterious to this <br />neigborhood as is planned today when the restrictions <br />spelled out by the PZ are in place. <br />M/S/P Hunt/Armstrong - to call a Special City Council Meeting for <br />Monday, July 23, 1990 at 2:00 p.m, to consider the request from Ray <br />Salus for a rezoning to Agricultural and a C.U.P. for a golf driving <br />range. (Motion carried 3-0). <br />B. Continuation of Variance Request by Joseph Kiesling at <br />9359 Jane Road N. <br />At the June 19th meeting, the applicant requested postponement of <br />council. consideration on his request until the next City Council <br />meeting. <br />M/S/P Armstrong/Hunt - to bring back the request by Joseph Kiesling <br />for Council consideration. (Motion carried 3-0). <br />Mayor Dunn: When you (Joe Kiesling) put in the concrete patio <br />underneath the proposed walkway, was this patio approved by the DNR3 <br />Kiesling: Everything that is there, including the patio and grading, <br />was looked at and approved by the DNR, <br />
