Subd. 4. Standards <br />Dredging, ditching, excavating, the placement of fill, the placement of <br />a structure or any other activity which results in a change in the rate of <br />water drainage from the wetland or negatively impacts the character of the <br />wetland, shall be permitted by the District only if all of the following <br />conditions are met: <br />1. The applicant demonstrates a need for the alteration. A <br />demonstrated need is the ability to acquire a reasonable profit <br />from the property when taking into consideration the applicable <br />wetland regulation in force at the time of purchase. <br />2. The applicant demonstrates the absence of reasonable alternatives <br />for the alteration. A reasonable alternative is one which has <br />fewer adverse impacts upon the wetland and would not result in <br />other significant adverse environmental consequences. <br />3-.-- The alteration --will _not -increase_- the -rater_ temperature of a - <br />receiving trout stream. <br />4. The alteration will not reduce the existing storage volume in the <br />immediate watershed. Storage volume will be determined as stated <br />elsewhere in these Rules and Regulations. <br />5. The alteration meets all other requirements of the District rules <br />and regulations. <br />Subd. 5. Criteria <br />The functional values and acreage lost as a result of a wetland <br />alteration shall be replaced according to the following criteria: <br />1. Replacement wetlands shall be of equal or greater public value <br />in terms of water retention, water quality enhancement, <br />wildlife habitat, recreation, aesthetic quality and <br />educational value. Water quality enhancement value of the <br />wetland will be measured according to a model acceptable to <br />the District. Water retention, wildlife habitat and aesthetic <br />value will be measured according to "The Minnesota Wetland <br />Evaluation Methodology For The North Central United States", <br />prepared by the Corps, in conjunction with the Minnesota <br />Environmental Quality board, September, 1988. <br />3. Replacement wetlands shall be located within the District. <br />5 C <br />
