LAKE ELMO CITY COUNCIL MINUTES NOVEMBER 20, 1.990 PAGE 6 <br />M/S/P Graves/Hunt - to direct the City Engineer to prepare a <br />feasibility report for an overlay project on Hytrail Avenue - <br />Highlands Trail to 59th Street. (Motion carried 4-0). <br />4. MSA Maintenance Project <br />5. Annual Patch & Overlay Maintenance Project <br />No Council action was required on these items at this time. <br />B. Final Payment for 39th Street <br />City Engineer, Larry Bohrer, reported work on the 39th Street project <br />with Brookman 2.nd and 3rd Additions is complete and ready for final <br />acceptance and issuance of final payment. (See Final Estimate and <br />Certificate No. 5 in the amount of $8,637.59.) Also, Compensating <br />Change Order No. 1 shows that the final contract amount is $7,022.00 <br />more than the original bid. This cost overrun is due to the fact that <br />MnDOT required a turn lane to be constructed after the contracts had <br />been awarded. <br />Bohrer recommended the City accept the work, approve Compensating <br />Change Order No. 1 and authorize final payment in the amount of <br />$8,637.59 to be passed through to the developer. <br />M/S/P Armstrong/Hunt - to accept the work done by C.W. Houle, Inc. in <br />its construction of. 39th Street and to approve Compensating Change <br />Order No. 1 in the amount of $7,022.00. (Motion carried 3-0). <br />M/S/P Armstrong/Hunt - to authorize final payment No. 5 to C.W. Houle, <br />in the amount of $8,637.59 and to instruct the staff to pass through <br />this amount to the developer in accordance with the developer's <br />agreement. (Motion carried 3-0). <br />C. Light at 39th St. & Hwy 5 <br />The City received a letter from the Lake Elmo Bank requesting a street <br />light be placed at the intersection of 39th Street and Highway 5. <br />The City Engineer was directed to follow the <br />contacting NSP to determine appropriateness <br />point, if power is available and if there an <br />Bohrer will report back to the City Council. <br />9.
