RESOLUTION 88-16 <br />A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO THOMAS G. <br />ARMSTRONG TO ALLOW THE ALTERNATIVE AGRICULTURAL USE OF <br />CERTAIN BUILDINGS ON PREMISES USED FOR STORAGE IN THE <br />AGRICULTURAL ZONING DISTRICT <br />WHEREAS, Thomas G. Armstrong has applied for a Conditional Use <br />Permit under the Alternate Uses Section of the Agricultural zoning <br />district to allow the operation of existing storage business (indoor <br />and outdoor), and to allow for the future construction of two <br />additional agricultural style buildings for storage use in areas <br />designated in the site plan submitted to the City; and <br />WHEREAS, the proposed Conditional Use Permit was requested to <br />apply to the entire 254.6 acres (less road right of ways) of <br />agricultural real estate currently owned in the City of Lake Elmo by <br />Thomas G. Armstrong as contiguous real estate, described as follows: <br />The Northwest Quarter of Section 28, Township 29 North, Range 21 West, <br />Washington County, State of Minnesota, containing 160 acres, more or <br />less. <br />The East Half of the Southwest Quarter of Section 28, Township 29 <br />North, Range 21 West, Washington County, containing 80 acres, more or <br />less. <br />The Northwest Quarter of the Southwest Quarter of Section 28, Township <br />29 North, Range 21 West except the westerly 780 feet thereof and <br />except the following described parcel, to -wit: Commencing at the <br />northwest corner of said Northwest Quarter of the Southwest Quarter, <br />thence east along the north line of said parcel for 780.0 feet to the <br />point of beginning of this description; thence continuing east along <br />said north line of the Northwest Quarter of the Southwest Quarter for <br />160.0 feet; thence south at right angles for 360.0 feet; thence west <br />at right angles for 160.0 feet; thence north at right angles for <br />360.00 feet to the point of beginning, said parcel containing 14.6 <br />acres, more or less. <br />WHEREAS, Section 301.070 D.l.b.(6) of the City of Lake Elmo <br />Municipal Zoning Code permits up to six acres on this contiguous site <br />to be set aside for alternative agricultural use under the provisions <br />of that section; and <br />WHEREAS, an existing use of that site, consisting, in particular, <br />of three buildings with some additional outside usage, involves the <br />rental of space for storage purposes; and <br />WHEREAS, the aforesaid Zoning Code would permit on the premises <br />storage of up to one vehicle for each 2-1/2 acres, or up to 100 <br />vehicles, would be permitted for outside storage; and <br />WHEREAS, it appears that this particular applicant has met the <br />requirements of Section 301.070 D.l.b.(6) and that the proposed use is <br />in conformity with that provision, as well as the City's other <br />ordinances and Comprehensive Plan. <br />
