LAKE ELMO CITY COUNCIL MINUTES APRIL 2, 1991 PAGE 3 <br />M/S/P Williams/Dick Johnson - to postpone consideration of Gregory <br />Lohmer's request for construction of a lakeside deck variance request <br />until such time as the applicant comes back to the City for action for <br />6 months. After 6 months, the existing request will be terminated. <br />(Motion carried 5-0). <br />M/S/P Mottaz/Hunt - to deny the request for the sideyard setback <br />variance based on the (1) lack of a hardship and (2) the request of a <br />variance for 6" where 10' is required is too close to the neighbor's <br />property line. (Motion carried 5-0). <br />B. Shoreland Permit: Gary Lee, 9344 Hidden Bay Trail <br />Gary Lee, 8344 Hidden Bay Trail, is requesting a shoreland permit to <br />construct a 20' x 20', two level deck to the house on the lake side.' <br />There will be a 3' wood stairway with periodic landscaping leading <br />from the deck to a natural trail toward the back (as shown in the site <br />plan submitted to the City). Since the deck and stairway are not in <br />the OHWM, no variances are required. <br />M/S/P Williams/Dick Johnson - to grant Gary Lee, 8344 Hidden Bay <br />Trail, a shoreland permit for the purpose of constructing a two level <br />deck and stairway based on no variances are required and all <br />structures will be more than 75' from the OHWM. (Motion carried 5-0). <br />Cl. Arabian Hills: Rezoning <br />At their March 25th meeting, the Planning Commission recommended <br />approval for the rezoning of the property to be known as "Arabian <br />Hills" from Rural Residential to Residential Estates. <br />M/S/P Hunt/Williams - to adopt Ordinance 8041 rezoning the property <br />described in said ordinance from Rural Residential to Residential <br />Estates based on the fact that the land conforms to the 1990 <br />Comprehensive Plan's Future Land Use Map and on the recommendation of <br />the Planning Commission at its March 25, 1991 meeting, and it is the <br />intent of the Council to have the minutes of the meeting and motion <br />serve as Findings of Fact. (Motion carried 5-0). <br />2. Arabian Hills Preliminary Plat <br />At its March 25, 1991 meeting, the Planning Commission on a 6-0-1 vote <br />recommended that the Council grant preliminary plat approval to <br />Arabian Hills; subject to the resolution of the park land dedication <br />and to the plat meeting all the recommendations listed (1-7) of City <br />Planner Black's report dated March, 8, 1991. <br />M/S/P Mottaz/Williams - to postpone action on this item until after <br />Agenda Item 6F. is discussed. (Motion carried 5-0). <br />M/S/P Williams/Mottaz - to amend the Council agenda to consider Item <br />6F at this time. (Motion carried 5-0). <br />
