LAKE ELMO CITY COUNCIL MINUTES MAY 7, 1991 <br />D. Preliminary Plat: John Day Farm Addition <br />PAGE 6 <br />The Planning Commission held a public hearing on April 22, 1991 to <br />consider the John M. Day Farm Addition preliminary Plat. The Parks <br />Commission has reviewed this plat and recommends that the City accept <br />a park dedication fee in lieu of land. <br />Findings of Fact: <br />1. The proposed lots in subdivision meet the minimum requirements <br />for the Rural Residential Zoning district. <br />2. The proposal is consistent and compatible with development in <br />the area. <br />3. The applicant has provided soil borings and percolation tests <br />as required by code. <br />4. <br />The proposed <br />plat is consistent <br />with the <br />1990 Comprehensive Plan. <br />5. <br />There was no <br />opposition to the <br />proposed <br />subdivision. <br />M/S/ Mottaz/Hunt - to grant preliminary plat approval for the John Day <br />Farm Addition based on the above listed findings of fact, based on the <br />recommendation of the Planning Commission, subject to the conditions <br />set forth in the City Planner's report dated April 30, 1991, the City <br />Engineer's report dated April 18, 1991, and the Parks Commission <br />recommendation to accept cash in lieu of land. <br />Discussion followed as to which park dedication ordinance this plat <br />would fall under since the Council is updating the current park <br />dedication ordinance. <br />M/S/ Mottaz/Williams - to amend the motion to include the amount of <br />cash dedication to be determined before Final Plat. approval. <br />The City Attorney indicated that the Final Plat, at time of approval, <br />will be locked into the current park dedication ordinance. <br />M/S/P Mottaz/Dave Johnson - to postpone consideration of motion until <br />the first City Council meeting in June. (Motion carried 4-1: Hunt: He <br />felt the Council should have given the applicants time to speak). <br />Ms. Margaret A. Juhl, personal representative of the estate of Johm M. <br />Day, stated with their approval, the family would accept the fee of 4% <br />of cash value in order for them to proceed with submittal of the Final <br />Plat. <br />M/S/P Mottaz/Hunt - to reconsider the motion. (Motion carried 5-0). <br />M/S/P Williams/Mottaz - to amend the motion to include the park fee <br />shall be set at 4% of the cash value or whatever is set by the park <br />dedication ordinance whichever is less. (Motion carried 5-0). <br />
