LAKE ELMO CITY COUNCIL MINUTES JUNE 4, 1991 PAGE 3 <br />(3) The soil type descriptions, as shown in the Washington County <br />Soil Survey, are 155D, 49B, 302C & 155B, are attached. A very <br />preliminary review of these soils indicates that most of this land is <br />suitable for development. <br />(4) The property owner would have to prove that the land is suitable <br />for development and meet all the conditions set forth in the Lake Elmo <br />platting ordinance and must receive approval from the VBWD. <br />(5) A map has been provided that shows the general location of the <br />proposed use within the community. <br />(6) A map showing all principal land use within 350 feet of the <br />parcel under consideration has been provided. <br />(7) The property owner has provided a legal description of the <br />property and staff has verified ownership. <br />(8) The property owner has provided a list showing the names and <br />mailing addresses of recorded owners within 350 feet of the property <br />and said owners were notified. <br />and based.on a determination of the City Attorney as to how the <br />disputed 4+ acres should be handled. (Motion carried 5-0). <br />B. Park Land Dedication Ordinance No. R046 <br />Resolution No. 91-18: Establishing Park Dedication Fees <br />for Residential Subdivisions of 3 parcels or less <br />The Council received a revised draft of the Ordinance relating to <br />public use dedications which incorporates the concerns expressed by <br />the City Council on May 7, 1991. In addition, the City Attorney <br />inserted an amendment to Section 105.030(C) which previously indicated <br />that the park land dedication for new lots would be $450.00. <br />M/S/P Williams/Dick Johnson - to adopt Ordinance 8046 as amended, <br />amending Sections 105.030(C), 401.400(A) through 401.400(F); adding <br />Sections 401.400(D)(1) through 401.400(D)(3), and 4:01.450; and <br />repealing Sections 401.400(F)(1) through 401.400(F)(3), 4:01.400(G), <br />401.400(H), 401.400(I) and its subdivisions, and 401.400(1) and its <br />subdivisions of the Lake Elmo City Code relating to park land <br />dedications. (Motion carried 5-0). <br />The Council reviewed Resolution No. 91-19 establishing park dedication <br />fees ($700.00 for each new residential lot in subdivision) for <br />Residential Subdivisions of three or less parcels. <br />M/S/P Hunt/Dick Johnson - to adopt Resolution No. 91-18 establishing <br />park dedication fees for Residential Subdivisions of three or less <br />parcels. (Motion carried. 5-0.) <br />
