LAKE ELMO CITY COUNCIL MINUTES NOVEMBER 19, 1991 6 <br />plan, that I could support the extension of the MUSA because <br />there are a number of things missing that are not there today <br />such as residential development in the area of the southern part <br />of the City and residential estates is not directly called out in <br />the 1983 version. <br />M/S/P Williams/Hunt - to rescind the application for a MUSA <br />extension to the Metropolitan Council. (Motion carried 3-2: Mayor <br />Johnson: I see this as an attempt on the part of one Councilman <br />to renege on his stated belief that high quality commercial <br />development along I-94 is essential to our tax base, therefore, <br />the only way this is going to come is thru extension of MUSA, <br />Mottaz). <br />The City Administrator will write a letter to the Metropolitan <br />Council indicating the action taken by the Council and to request <br />return of all documents. <br />B. PUBLIC HEARING: Variance to frontage on a <br />public street: Carmelite Monastery, <br />8251 DeMontreville Trail <br />Mayor Johnson called the public hearing to order at 10:35 p.m. in <br />the Council chambers. The public hearing notice was published in <br />the November 6, 1991 St. Croix Valley Press and adjoining <br />property owners were notified. <br />Dick Sachs, Fire Chief, submitted a letter indicating the road <br />was designed to safely carry emergency vehicles. <br />D. Meier stated she appreciated their neighbors, the quiet nature <br />of the setting, and the roads out to Hidden Bay Trail are well <br />plowed. She would feel badly about another access because it <br />would destroy the quality of this area. <br />Mayor Johnson closed the public hearing at 10:50 p.m. <br />Rev. Burns stated he had contacted Mr. Skalbeck who was not happy <br />about the idea of putting in another road. Rev. Burns submitted <br />a copy of deed showing Carmelite acquired their property together <br />with the easement over the Jesuit property. <br />Council voiced their concern on approving this variance starting <br />a troublesome precedent for the City. The City Attorney advised <br />the Council they could develop findings of fact (such as; <br />property is served by a private easement, Fire Chief has <br />indicated no problem accessing the property from a public street, <br />the property has on -site shelters, low density of this use with a <br />population of 14) to support approval this particular variance. <br />M/S/P Dick Johnson/Mottaz - to postpone action of this item until <br />December 3rd Council meeting and direct the City Administrator to <br />prepare a resolution incorporating the attorney's comments to <br />protect the city. (Motion carried 5-0). <br />
