LAKE ELMO CITY COUNCIL MINUTES DECEMBER 3, 1991 5 <br />6. PLANNING/LAND USE & ZONING: <br />A. PUBLIC HEARING: Shoreland Permit with Variance <br />Dorothy Hanson, 7978 Hill Trail N. <br />Mayor Johnson opened up the public hearing at 9:15 p.m. in the <br />Council chambers. The public hearing notice was published in the <br />November 20, 1991 St. Croix Valley Press and adjacent property <br />owners were notified. <br />Dorothy Hanson, 7978 Hill Trail N., is requesting a shoreland <br />permit with a variance to setback from the Ordinary High Water <br />Mark for the purpose of constructing a 3-seasons porch where they <br />now have an existing deck. The required setback for the <br />principal structure is 100 feet from the ordinary high water <br />elevation. The applicant has stated that the proposed porch <br />structure will setback 51 feet from the OHWM and would be 2-feet <br />shorter than the deck. <br />The Council received letters from Timothy Gennrich, 7972 Hill <br />Trail N. and Charles Lea, 7982 Hill Trail N. indicating they had <br />no objection to granting the request variance for the purpose of <br />constructing a 3-seasons porch. <br />The Council received a letter from Molly Shodeen, DNR, <br />questioning whether there are alternatives to construct the porch <br />on the east side of the house. <br />Mayor Johnson closed the public hearing at 9:25 p.m. <br />Because the packet was received late, several councilmen did not <br />have time to visit this property. Therefore, the following <br />motion was made: <br />M/S/P Hunt/Williams - to postpone consideration of this request <br />until the December 17th Council meeting. (Motion carried 5-0). <br />7. OLD BUSINESS• <br />A. Carmelite Monastery variance to frontage on a public <br />dedicated road, Resolution No. 91-40. <br />M/S/P Dick Johnson/Hunt - to adopt Resolution No. 91-40, A <br />Resolution Granting a Variance to the Carmelite Monastery from <br />Section 301.090I. of the Lake Elmo Municipal Code (Frontage on a <br />public road). (Motion carried 4-1: Mottaz: This goes beyond a <br />private road. It's opened to the public and the city has <br />responsibility that all safety concerns are considered.) <br />B. Septic System Ordinance: Discussion with Tom Palecek, <br />Pinky's Sewer Service was held under Public Inquiries. <br />
