LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 4, 1992 7 <br />The Council indicated they felt it would have been nice <br />to be involved in this program, but it was too expensive. <br />9. CITY ATTORNEY'S REPORT: <br />A. Trail Head Development <br />Jerry Filla reported Judge Quinn decided on January 24, 1992 <br />that he would award Trail Head Development $2500 in legal <br />fees for the work done on the Appellate Court review and <br />that he would reduce the sanctions against the City from <br />$3500 to $100. Both amounts need to be paid by February 7, <br />1992. <br />B. Recommendation on Hammes Mining <br />The Council requested options for enforcing its regulations <br />on the Hammes Mining Site. <br />Attorney Filla reported the following options: <br />1. Revocation of Conditional Use Permit <br />2. Criminal Citations <br />3. Civil Complaint <br />4. Property Owner Consent to Removal of Hazards <br />5. City Order to Remove Hazards <br />Information regarding these options will be submitted in <br />written form by Filla and copied to Hammes Mining. <br />Before the City reviews the CUP again, Filla recommended <br />they look at the 1987 version and bring it up to -date as <br />some of the references are old. <br />Councilman Williams indicated he was willing to take a <br />firmer step because Hammes' have not worked on cleaning up <br />the barn in the last two months and have not met one date on <br />their clean-up schedule. <br />Mayor Johnson indicated he was impressed with the number of <br />cars that have been removed and was willing to go to the <br />April/May timeframe and review the property then. <br />Councilman Hunt reported the Council had discussed <br />continuing monthly updated reports from the Code Enforcement <br />officer. <br />
