LAKE ELMO CITY COUNCIL MINUTES APRIL 21, 1992 10 <br />7. CITY ENGINEER'S REPORT: No report <br />8. CITY ATTORNEY'S REPORT: <br />A. Hammes <br />The Council asked that Jim McNamara meet with the Hammes <br />family and develop a rational clean-up schedule. If any of <br />the clean up deadlines cannot be met, a citation will be <br />issued by the Code Enforcement Officer for each area in non- <br />compliance, and the city will proceed with civil court <br />action. The council would like to see the schedule at the <br />next council meeting. The Council made it very clear they <br />wanted this site cleaned up by the end of this year. <br />Mayor Johnson explained that on the Hammes Property, there <br />is a young man that is operating a transfer station for the <br />recycling of glass that comes from commercial establishments <br />in Lake Elmo. The operator and the Hammes were told 60 days <br />ago to apply for a CUP for such an operation. The Council <br />directed this proposal be sent to the Solid Waste Committee <br />and to the Planning Commission for consideration. The Solid <br />Waste Commission has recommended to not approve such an <br />application. <br />M/S/P Mayor Johnson/Dick Johnson - to grant an extension for <br />30 days from May 4th for clean up operation of the transfer <br />station for recycling glass with the provision during the <br />30-day period there will be no further glass collected and <br />brought to the site on the Hammes property while the PZ <br />investigates whether or not we should amend our regulations <br />and allow this use. If the PZ recommends allowing such a use <br />the applicants should apply for an amendment to their CUP, <br />but if the use is not allowed the operation should cease <br />immediately. (Motion carried 4-0). <br />B. Comp Plan - Administrative Judge Cost <br />Attorney Filla reported that the cost for an Administrative <br />Law Judge is $86/Hour, and the city would have to sign a <br />contract identifying the issue you want to be reviewed. <br />This is a process that would result in a non -binding <br />opinion. The Administrative Law Judge office had a concern <br />about making sure they understand specifically what it is <br />the city would like to be reviewed. This is not something <br />typically that their office undertakes and until they see a <br />definition of issues they cannot tell us for sure if they <br />will undertake this one. <br />C.
