LAKE ELMO CITY COUNCIL MINUTES APRIL 21, 1992 8 <br />D. MUSA Update <br />The Met Council will be voting on the City's amendment for <br />MUSA Extension on Thursday at 4:00 p.m. If the request is <br />not granted, the City Administrator suggested resubmitting <br />another application including 120 acres. <br />Mayor Johnson indicated he will be meeting with Mary <br />Anderson of Met Council to try to resolve this transfer of <br />capacity. <br />Councilman Williams indicated he was in favor of proceeding <br />with an amended MUSA application, but only on the condition <br />that no more money come out of city coffers for this. The <br />Council is talking about extending the MUSA line to include <br />essentially one owner's property, United Properties. He <br />would like to propose we tell United Properties if they are <br />interested in having the MUSA line extended we are willing <br />to carry it through with full intention of implementing it, <br />but that we are going to require them to put $2000 in an <br />escrow fund. We will draw on that escrow fund to pay our <br />staff costs which is consistent with what we do in <br />subdivision, rezoning applications. We have shown more than <br />good faith in the amount of money spent so far and think it <br />is time for the property owner to put up if he wants to <br />continue the process. <br />Mayor Johnson explained he believed we should be able to get <br />some assistance and has been trying to get ahold of the <br />Governors's office. The problem he had was that we have <br />talked to other people along that 440 acres who are going to <br />worry about the city reducing the scope of the MUSA <br />extension. <br />Tom Prew stated the only people allowed to run a treatment <br />plant in the seven county area is the MWCC. Lake Elmo can <br />build a plant, but we can't operate one. <br />Councilman Johnson agreed with the concept of having to stop <br />spending money out of city coffers, and that it was now up <br />to the property owner. At the hearing he attended, Johnson <br />noted the Mayor stated it wouldn't cost the Met Council or <br />any other government agency any money to accept this <br />additional sewer capacity. He wanted to make it clear it is <br />this city's intention that the taxpayer of Lake Elmo is not <br />going to cover this burden, and we discussed this at a <br />number of occasions. Johnson voiced his concern when the <br />Mayor and Mike Black make the statement to the Met Council <br />that we, as a city, are going to cover all the costs. <br />
