LAKE ELMO CITY COUNCIL MINUTES JULY 7, 1992 6 <br />B. Ordinance 8068, Rezoning from RR to AG, <br />Tom Soderberg <br />At their June 22nd meeting, the Planning Commission <br />recommended the approval of the rezoning from RR to Ag and <br />recommended approval of the CUP for a stable used for <br />boarding and training of horses with conditions. The <br />reasons for their approval were: 1) Maintain open spaces <br />that the Comprehensive Plan has stated that we desire, 2) It <br />is not detrimental to the health, safety and welfare of the <br />residents, 3) It is consistent with the intent of the <br />Agricultural zoning district uses, 4) It provides a service <br />to the residents of Lake Elmo that does not currently exist, <br />5) Based on the standards of the applicant's property in <br />Hudson, the proposed facility as reflected in the <br />architectural and landscape plan would enhance the <br />facilities in the City of Lake Elmo. <br />The Council received a letter from Ron Smith, 9999 10th St. <br />N., asking the city to welcome Mr. Soderberg to Lake Elmo. <br />Mayor Johnson indicated he shared the concerns of Washington <br />County Parks and Public Works on traffic hazards and access <br />to the Park. From his estimation this is a commercial <br />operation, and he did not receive any overwhelming <br />information to downzone this property to Ag for an upzoning <br />to a commercial business. He would like to see the PZ work <br />on Limited Business zoning ordinance and provide for this <br />type of use within our LB Ordinance. <br />M/S/F Hunt/Williams - to adopt Ordinance 8068, Rezoning from <br />RR to Ag. (Motion Failed 3-2: Mayor Johnson: This would <br />result in a downzoning to agricultural land for an upzoning <br />to commercial use; Mottaz: This is not a rezoning to put the <br />land to agricultural use and we cannot separate the rezoning <br />from the CUP. This proposal is an overuse for this property <br />and this proposed commercial operation is right across the <br />street from the Stonegate development). <br />Mr. Soderberg explained that the City's ordinance for Ag <br />zoning permits horse stables as a conditional use and the <br />Future Land Use Map shows this area as RAD which includes <br />both Rural Residential and Agricultural. Soderberg added <br />that he had been approached by the Mayor after the first PZ <br />meeting who told him that he would not vote for this <br />rezoning with a CUP attached to it. <br />The City Attorney pointed out that the code states the <br />applicant could not reapply for a rezoning for six months <br />after it has been denied. <br />
