LAKE ELMO CITY COUNCIL MINUTES SEPTEMBER 1, 1992 <br />Mayor Johnson stated in doing this it is not conveying in <br />any way the impression that the city is committed to <br />developing an equestrian trail; and Washington County parks, <br />upon the approval of the County Board, would not accept an <br />entrance thru the park unless it is maintained by the city. <br />M/S/P Mottaz/Mayor Johnson - to approve Resolution No. 92- <br />19, as amended, A Resolution granting a CUP to Genie <br />Arabians, Inc. d/b/a St. Croix Equestrian Center for the <br />Operation of a stable and an equestrian boarding and <br />training center; conditioned upon: (1) the applicant <br />conveying an easement as described by the city planner in <br />his memo to the city dated July 1, 1992 and (2) the rezoning <br />of this property from Rural Residential to Agriculture; and <br />under no circumstances was requirement for dedication of a <br />trail a guarantee on the part of the city that it would be <br />improved in the future. (Motion carried 4-0). <br />Tom Soderberg asked that the rezoning of the land be <br />contingent upon their purchasing of the land. <br />M/S/P Williams/Hunt - to adopt Ordinance 8070, An Ordinance <br />amending Section 301.070C of the 1979 Lake Elmo Municipal <br />Code at it relates to the zoning district map by changing <br />the zoning from Rural Residential (RR) to Agricultural (A) <br />of said property contingent upon the applicant, Genie <br />Arabians Inc. d/b/a St. Croix Equestrian Center purchasing <br />the property. (Motion carried 4-0). <br />6. PLANNING/LAND-USE & ZONING: <br />A. Lot Consolidation, Ordinance No. 80 <br />In Mike Black's letter to the Council, he suggested that <br />Section 401.042 Exceptions to Platting, be rewritten to <br />include the following: <br />The City Council may waive all or a portion of the <br />platting requirements for a simple lot division IN THE <br />AGRICULTURE OR ANY RESIDENTIAL ZONE. <br />Black also suggested rewording of Paragraph B.4.: <br />4. A land survey prepared by and signed by a registered <br />land surveyor describing the simple lot division showing all <br />buildings, driveways, easements, setbacks and other <br />pertinent information and including new legal descriptions <br />for all resulting parcels. <br />After reviewing the proposed ordinance, the Council <br />eliminated A.(2) and asked criteria (3) and (4) refer to <br />appropriate code sections. Attorney Filla will incorporate <br />the criteria needed in the ordinance to deal with submission <br />requirements in Section 401.260. <br />
