CITY ENGINEER'S REPORT: No Report <br />8. CITY ATTORNEY'S REPORT: <br />Attorney Filla reported that the appellate court denied the <br />Mn/DOT appeal so that Oakdale can proceed with the <br />signalization of Hadley and Hwy 36. If Mn/DOT wants to <br />contest that, they will have to go back to District Court <br />September 28th. <br />9. CITY COUNCIL REPORTS: <br />Mayor Johnson submitted a resolution for council review <br />soliciting Minnesota Municipal Board Action to detach <br />Section 32 and Section 33, Township 29 from the Municipal <br />Authority of the City of Oakdale to that of the City of Lake <br />Elmo because the Municipal Board's action was not in <br />accordance with the statutory.requirements. The City of <br />Lake Elmo cannot own streets in Oakdale. <br />M/S/ Mottaz/Hunt - to instruct the City Administrator to <br />have discussion with the Oakdale's City Administrator on the <br />different options of the trade off of the roads for this <br />southeast triangle of property and try to come up with some <br />kind of agreement. <br />M/S/P Williams/Hunt - to amend the motion to include the <br />city administrator contact the Executive Director of the <br />Municipal Board to discuss action to resolve this situation. <br />(Motion carried 4-0). <br />M/S/P Mottaz/Hunt - to instruct the City Administrator to <br />have direct discussion with Oakdale's City Administrator on <br />the different options to try to come up with some kind of <br />agreement and further, the city administrator contact the <br />Executive Director of the Municipal Board to discuss action <br />to this situation. (Motion carried 3-1: Mayor Johnson: We <br />have nothing to be gained by discussion with Oakdale and <br />there is a danger on the way we are proceeding). <br />OLSON LAKE ESTATES: <br />The Council received a report from Al Dornfeld, President of <br />the VBWD, on the Olson Lakes Estate Pond Outlet to Olson <br />Lake. <br />The Council asked that the City Administrator contact Gordon <br />Moosbrugger, VBWD, and inform him the City of Lake Elmo will <br />not take any water from the Olson Lake Estates development <br />and send a letter to the Tri-Lakes Assoc. indicating what <br />the city is doing and that we need their involvement. <br />
