PUBLIC HEARING: Shoreland <br />the required 100, setback from the <br />required 10, side yard setback. <br />Applicant: James P. Dillon, 8190 <br />Permit with variance from <br />NOHWM and variance to the <br />Trail N. <br />Mayor Johnson opened up the public hearing at 8:12 p.m. <br />the Council chambers. The public hearing notice was <br />published in the October 7, 1992 St. Croix Valley Press <br />adjoining property owners were notified. <br />There was no one to speak for or against the request. <br />Mayor Johnson closed the public hearing at 8:16 p.m. <br />MIS/ Williams/Hunt - to grant <br />yard variance, but not allow <br />closer to the water than the <br />following reasons: <br />in <br />and <br />the shoreland permit and side <br />any structure to be erected <br />old structure based on the <br />1. That the Staff has determined there is adequate room <br />for operation and expansion of the on -site septic system if <br />the variance is granted. <br />2. That because of the steep topography of the lot, the <br />proposed location minimizes the variances required. <br />3. That the proposal is to replace an existing non- <br />conforming structure. <br />4. That the City Planner has recommended approval of the <br />variance although his approval is predicated on <br />consideration of the proposed shoreland ordinance. <br />5. That Molly Shodeen, DNR, had no problem with the <br />request. <br />6. That the three conditions set by the City Planner be <br />included. (a) The shed shall not exceed 10, in height, (6) <br />the shed shall be painted earthtones, (c) Additional <br />landscaping is added between the shed and the shoreland to <br />reduce visibility as viewed from the public waters. <br />M/S/P Hunt/Mottaz - to amend the motion to strike the <br />portion of the motion that would restrict the shed being <br />built beyond the original boundaries 3-2: Williams and Dick <br />Johnson: It is inappropriate to use a proposed shoreland <br />ordinance that has not been discussed fully by the council <br />as a basis for this amendment when considering a variance <br />request under our existing ordinances. This is poor public <br />policy.) <br />
