LAKE ELMO CITY COUNCIL MINUTES MARCH 16, 1993 2 <br />The Council amended the submitted agreement as follows: <br />First Paragraph Amended to read as follows: <br />The City of Lake Elmo, Minnesota (hereinafter "City") hereby <br />grants to Washington County the right to enter on, construct <br />and maintain three methane detection wells in the northeast <br />corner of Parcel 0115 in the locations as approved by the <br />City, Parks Supervisor or his delegate, and with minimal <br />damage to trees. <br />M/S/P Johnson/Conlin - to approve an agreement, as amended, <br />between Washington County and the City of Lake Elmo for the <br />installation of methane gas monitoring wells on city owned <br />property; contingent upon Washington County entering into an <br />indemnification and hold harmless agreement approved by our <br />City Attorney. (Motion carried 3-0). <br />5. OLD BUSINESS: None <br />6. PLANNING/LAND USE & ZONING: <br />A. Petition for rezoning from R1 to RE <br />The City received a petition from five of the seven property <br />owners within the R1 portion and one property owner in the <br />RR portion of Midland Meadows requesting a rezoning from R1 <br />to RED. The property owners have stated that they were told <br />by the Realtor that the lots could not be zoned R1 which <br />allows for a minimum lot size of 1-1/2 acres. Tony <br />Collette, property owner in the R1 portion on 4.09 acres, <br />has applied for a minor subdivision which is scheduled to go <br />before the Planning Commission on March 22, 1993, <br />Dave Richter and Terry Erickson explained they bought these <br />lots with the understanding they would remain rural and <br />could not be subdivided. Richter also questioned driveway <br />access for the Collette property. <br />Mike Lukin felt it's a benefit to the Lake Elmo community <br />that the propertyowners rezone up and protect the land <br />around them. <br />Since the Planning Commission is going to look at the Comp <br />Plan for possible zoning changes to the bordering properties <br />of Lake Elmo, Denise Richter asked if they could look at <br />their area at the same time? <br />Tony Collette reported when he purchased his property, it <br />was zoned R1 and bought it with the intention of doing a <br />minor subdivision. He placed his house in an appropriate <br />place for when the time came to split it this opportunity <br />was available to him. He checked with the City for what, was <br />required and has met all the requirements of the Minor <br />Subdivision Ordinance: survey, perk tests, paid an <br />application fee.
