LAKE ELMO CITY COUNCIL MINUTES MARCH 16, 1993 3 <br />and according to his attorney, that easement runs with the <br />land regardless of whether or not it remains a single parcel <br />or is split. Joe Lux, Washington County, informed him that <br />all he had to do was apply for a driveway permit and the <br />County had no problem issuing the driveway permit. <br />Attorney Filla explained if the city feels that changing the <br />Comprehensive Plan and the corresponding rezoning for the <br />area is in the best interest of the city, the council has <br />the right to do that including Lot 7. Even if you conclude <br />that you want to allow these things to continue on <br />concurrent tracks, his recommendation would be to continue <br />to include the collette property in this new zoning. This <br />means that the collette property will become a non- <br />conforming use. He would not recommend that the council <br />carve out a parcel of R1 land surrounded by some other <br />designation. <br />M/S/P Johnson/Conlin - to accept the petition from the <br />residents for a rezoning from R1 to RED, (Comprehensive Plan <br />Amendment) and direct the staff to prepare a resolution <br />suitable to cover this matter for review at the April 6th <br />council meeting. Items included in Resolution: refer this <br />area to Planning Commission for study and direction and at <br />the same time the PZ set a public hearing for a Development <br />Moratorium for area affected to be determined by consultants <br />and PZ. (Motion carried 3-0). <br />The Planning Commission is reviewing the Ordinance on moving <br />buildings into the city. <br />B. Land Surveyor's Certificate Correction to <br />Midland Meadows, Lot 7, block 1 <br />M/S/P Conlin/Johnson - to approve the request for a Land <br />Surveyor's Certificate of Correction of Plat, as it relates <br />to Lot 7, Block 1, Midland Meadows whereby the distance <br />along the south side of the drainage easement which is shown <br />as 210.00 feet be correct to show the actual dimension of <br />410.00 feet. (Motion carried 3-0. <br />C. Petition for the Establishment of the <br />Cottage Grove Watershed District <br />The City received a copy of the draft petition for the <br />establishment of the Cottage Grove Ravine Watershed <br />District. Both Woodbury and Oakdale have approved this <br />petition. Attorney Filla reviewed the petition and reported <br />he had no concerns with the content of the petition. <br />M/S/P Conlin/Johnson - to approve the petition for the <br />establishment of the Cottage Grove Watershed District. <br />(Motion carried 3-0). <br />
