LAKE ELMO CITY COUNCIL MINUTES MAY 4, 1993 3 <br />The City's position is Mr. Burgess is operating an illegal <br />( business, the matter is in our city attorney's hand, and we <br />will continue to proceed in court to clean-up the property. <br />Other situations will be investigated and action, as <br />required, will be taken. <br />5. OLD BUSINESS: <br />A. Update on City Council Informational Requests <br />M/S/C Conlin/Johnson - to direct the staff to prepare a <br />draft policy for checking out keys to the City facilities <br />and access to the city office. (Motion carried 5-0). <br />M/S/C Mottaz/Johnson - to direct the Planning Commission to <br />discuss PF Zoning at their May 24th meeting. (Motion <br />carried 5-0). <br />B. St. Croix Animal Shelter's request for a "Community <br />Support Agreement" <br />Attorney Filla explained this would be a contract that would <br />be enforceable if signed and would obligate the city to <br />budget for the designated commitment. The Council suggested <br />directing an inquiry to the shelter asking them if they <br />would accept a provision for someone from Lake Elmo to serve <br />on the Board of Directors. <br />M/S/C Mottaz/Johnson - to postpone action on this item until <br />the next meeting in order for the City Attorney to review <br />the contract and direct an inquiry to the Shelter asking the <br />Board if they would consider a provision for someone from <br />Lake Elmo to be on their Board. (Motion carried 5-0)• <br />C. Street Standards, Request for Modification to <br />Engineering Standards adopted October 15, 1991 <br />Councilman Johnson informed Mr. Nelson that it is the city's <br />desire to have 9-ton streets in a development which was <br />reflected by a previous council motion. <br />M/S/C Mottaz/Johnson - to instruct the City Administrator <br />and City Attorney to determine as a result of dates of <br />preliminary Plat approval of Rolling Hills with the new or <br />old street standards if the city is legally obligated to <br />honor the old street standards, the council should be <br />informed. If not, the developer will be instructed it is the <br />position of the city to require compliance with the new <br />street standards. (Motion carried 5-0). <br />Attorney Filla will meet with Mr. Nelson to go through the <br />file on Wednesday afternoon at city hall. <br />
