LAKE ELMO CITY COUNCIL MINUTES MAY 4, 1993 4 6. PLANNING/LAND USE & ZONING: A. Conditional Use Permit Amendment Ray Salus, Country Air Golf M/S/C Mottaz/Conlin - to adopt Resolution No. 93-19, as amended incorporating the site plan submitted, A Resolution amending Conditional Use Permit No. 90-25 granted to Raymond and Jane Salus, Country Aire Golf Driving Range to include a three -hole practice/training golf course. (Motion carried 5-0). B. Continuation of non -conforming use in the Highway Business (HB) zoning district. (Kunz Oil Bldg, 4201 Stillwater Blvd.) Administrator Kueffner reported Mr. Kunz will be applying for a rezoning to General Business which will allow Tim Myrha to continue selling sod from the Kunz Oil Building, Attorney Filla indicated it is not good policy for the city to ignore ordinances. It is better for the city to adopt regulations that it wants to enforce and enforce the regulations that we have. M/S/C Mottaz/Conlin - the council allows the existing use to continue until June 1st council meeting; contingent upon the submission of a completed application for rezoning to General Business on or before May 10, 1993. (Motion carried 5-0). Filla explained to Mr. Myrha that this motion permits him to continue selling sod out of the Kunz Oil Building until the June 1st, 1993 City Council meeting; provided that a completed application for rezoning is submitted to the city by May 10, 1993. C. County Road 10 Reconstruction M/S/C Mottaz/Conlin - the Council makes the decision that the proposed reconstruction of County Road 10 does not conflict with the Lake Elmo Comprehensive Plan on Page 33 as indicated by the April 12, 1993 Planning Commission minutes. (Motion carried 3-2: Johnson: He does consider an amendment to the comprehensive plan is needed; Johnston: The language should be investigated further.)
