LAKE ELMO CITY COUNCIL MINUTES MAY 4, 1993 4 <br />6. PLANNING/LAND USE & ZONING: <br />A. Conditional Use Permit Amendment <br />Ray Salus, Country Air Golf <br />M/S/C Mottaz/Conlin - to adopt Resolution No. 93-19, as <br />amended incorporating the site plan submitted, A Resolution <br />amending Conditional Use Permit No. 90-25 granted to Raymond <br />and Jane Salus, Country Aire Golf Driving Range to include a <br />three -hole practice/training golf course. (Motion carried <br />5-0). <br />B. Continuation of non -conforming use in the Highway <br />Business (HB) zoning district. (Kunz Oil Bldg, 4201 <br />Stillwater Blvd.) <br />Administrator Kueffner reported Mr. Kunz will be applying <br />for a rezoning to General Business which will allow Tim <br />Myrha to continue selling sod from the Kunz Oil Building, <br />Attorney Filla indicated it is not good policy for the city <br />to ignore ordinances. It is better for the city to adopt <br />regulations that it wants to enforce and enforce the <br />regulations that we have. <br />M/S/C Mottaz/Conlin - the council allows the existing use to <br />continue until June 1st council meeting; contingent upon the <br />submission of a completed application for rezoning to <br />General Business on or before May 10, 1993. (Motion carried <br />5-0). <br />Filla explained to Mr. Myrha that this motion permits him to <br />continue selling sod out of the Kunz Oil Building until the <br />June 1st, 1993 City Council meeting; provided that a <br />completed application for rezoning is submitted to the city <br />by May 10, 1993. <br />C. County Road 10 Reconstruction <br />M/S/C Mottaz/Conlin - the Council makes the decision that <br />the proposed reconstruction of County Road 10 does not <br />conflict with the Lake Elmo Comprehensive Plan on Page 33 as <br />indicated by the April 12, 1993 Planning Commission minutes. <br />(Motion carried 3-2: Johnson: He does consider an amendment <br />to the comprehensive plan is needed; Johnston: The language <br />should be investigated further.) <br />
