LAKE ELMO CITY COUNCIL MINUTES JANUARY 25, 1994 <br />B. Oak Wilt Control Plan - Resolution No. 94-1 <br />Mike Bouthilet provided an Oak Wilt Control Program and adoption of this plan is <br />a prerequisite to obtain grant funds for oak wilt suppression. <br />M/S/C Johnson/John - to adopt Resolution No. 94-1, A Resolution Adopting the <br />City of Lake Elmo Oak Wilt Control Plan. (Motion carried 4-1: Mottaz:Trenching <br />is an expensive proposition and has not been determined to be fully effective in <br />controlling oak wilt.) <br />C. Erosion Control - Sunfish Park <br />Mike Bouthilet provided a memo describing erosion control measures that have <br />been taken in Sunfish Park. All areas are to be inspected in Spring of 1994 to <br />evaluate how well the erosion control efforts worked. <br />6. OLD BUSINESS <br />A. Conditional Use Permit Review (Jim McNamara) <br />Jim McNamara provided a review on the Conditional Use Permits for 1994. <br />Three CUP's, Hammes Mining, Jamie Olson Advertising sign, and Armstrong <br />(exterior storage), were not in compliance with the conditions set in their CUP. <br />Jamie Olson Advertisina Sign: <br />The support structure anticipated a 672 sq.ft. sign surface, but is limited to a 200 <br />sq.ft. surface so the structure is way beyond the sign surface. The city has not <br />pursued that because all of these matters were going through various stages of <br />appeal. The time for appeal expired at the end of December. There is no <br />litigation pending between the city and Jamie Olson. Her permit does indicate <br />that the supporting structure of the sign shall not increase the perimeter of the <br />sign anymore than 2 feet in any direction. The city may request that she <br />reconfigure the supporting structure of the sign. <br />M/S/C Mottaz/Conlin - to direct the staff to send a letter to Jamie Olson stating <br />why she is not in compliance with conditions of CUP, give her reasonable time to <br />correct problem and indicate if it is not corrected in that time, the city's next <br />procedure will be to conduct a public hearing to consider rescinding the permit. <br />(Motion carried 5-0). <br />Armstrong (exterior storaae):Tom Armstrong had indicated to Jim McNamara <br />that at this time the number of vehicles stored on the property are not in <br />compliance with the condition set in the CUP. <br />Hammes Mining: By their own admission, Hammes Mining is mining too close to <br />the property line and a citation has been issued and they go to court on February <br />16, 1994. <br />
