Mary Kueffner, City Administrator <br />FROM: Steven Schwanke, City Planner .(933-0972) <br />RE: TH 5 Corridor Study <br />File # 93081A <br />922 Mainstreet <br />Hopkins, Mn. <br />55343 <br />(612)933-0972 <br />fax: (612) 933-1153 <br />zf�y <br />INTRODUCTION <br />At its meeting on December 13, 1993, the Lake Elmo Planning <br />Commission voted 6-3 to recommend the "future Land Use" be <br />' "Limited Business" (LB) for a triangular piece of property in,the <br />City south of TH 5, east of CR 13, west of Jamaca Ave. and north <br />of the railroad tracks,. (Please see the attached maps 1 and 2)e. <br />This new LB designation is to be similar,in.nature as the LB - <br />designation along.I-94. The three votes against the 'action were <br />related to insufficient time to fully evaluate the land use <br />issues and impacts associated with the action. <br />'At the same meeting, the Planning Commission voted 9-0 to have: <br />the City Planner review the above action of the Planning <br />Commission and prepare a written report for the City Councils <br />review. The following is the report requested by the Planning <br />Commission.. <br />ANALYSIS <br />The Planning Commission's discussion of land use issues along TH <br />5 was based on recent developments in the legal action taken by <br />Joe Rogers against the City of Lake Elmo. Mr. Rogers has <br />indicated a willingness to accept some form of commercial land <br />use. The City's legal representative.in .this matter.(League of <br />Minnesota Cities) has. found it difficult to find expert witnesses <br />supporting a low density residential land use for the Rogers <br />property. The Rogers litigation is currently inactive. <br />,( As a result of these events, the City of Lake Elmo Planning <br />Commission reconsidered whether the land along TH 5 should be <br />. Civil Engineering . Transportation . Infrastructure Redevelopment <br />.Landscape Architecture -Construction Management <br />
