LAKE ELMO CITY COUNCIL MINUTES JULY 19, 1994 3 <br />M/S/P John/Mottaz - to direct the staff to put together a proposal for construction of a <br />garage suitable for this vehicle and comeback with a recommendation on the old truck. <br />(Motion passed 5-0). <br />C. Stable Ordinance (Tabled) <br />D. Improvements in Private Developments <br />Larry Bohrer and Jerry Filla has reviewed the new ordinance submitted for council <br />consideration. <br />M/S/P Mottaz/Conlin - to adopt Ordinance 8099 repealing Section 401.505 and its <br />subdivisions and adopting Section 400.18 and its subdivisions relating to Required <br />Improvements/Financial Arrangements (in Subdivisions) as amended (9A. Add to end <br />of paragraph: ..."City Attorney, including, but not limited to, provisions for default <br />including fines and penalties."; Add to Subd. 10. "...developer may enter into an <br />agreement signed by 100% of all owners of the land to be developed, requesting the <br />City to install some or all of the improvements, request all of the costs be assessed <br />against the property and waiving the rights to appeal from the levied special <br />assessments." and correct typos). (Motion passed 5-0). <br />E. Olson Lakes Estates Pond Update <br />The Council received a memo from Administrator Kueffner expressing Attorney Chuck <br />Dayton's thoughts regarding the VBWD temporary discharge permit and the public <br />hearing scheduled for August 11. Attached to memo were results of testing on Olson <br />Lake Estates Pond submitted by Randy Peterson, Barr Engineering. <br />M/S/P John/Mottaz - to table discussion in order to review information submitted and <br />place item on August 2nd council agenda under UNFINISHED BUSINESS. (Motion <br />passed 5-0). <br />6. PLANNING/LAND USE & ZONING: <br />A. PUBLIC HEARING: Variances for Parking Area -Lake Elmo Elementary School <br />The Public Hearing notice for a variance to Section 301.130 requiring all parking areas <br />in non-residential zoning districts be covered with bituminous blacktop or concrete and <br />a variance to Section 301.130E(e) that requires a setback of 5 feet from the side <br />property line for off street parking areas was published in the July 11, 1994 Stillwater <br />Gazette Extra and adjoining property owners were notified. <br />Mayor John opened up the Public Hearing at 8:06 p.m. <br />
