Lake Elmo City Council Minutes July 5, 1994 <br />Page 5 <br />8. CITY ATTORNEY'S REPORT <br />A. Oakdale v. MNDOT, et al. Settlement Agreement regarding <br />Highway 36 and Hadley Ave. <br />The council received a memo, dated June 27, 1994, from the City Attorney along with a <br />Settlement Agreement which disposes of litigation between the City of Oakdale and MN/DOT <br />regarding the intersection at Hwy 36 and Hadley Ave. Lake Elmo was named as a party in the <br />Petition for a Writ of Mandamus. <br />MIS/P Johston/Johnson - to direct the Mayor and Administrator to sign the Settlement <br />Agreement which would allow the vacation of the Writ of Mandamus. (Motion passed 4-0.) <br />B. Joint Powers Consortia Agreement request from HRA <br />The council received a letter, dated June 8, 1994, along with a Joint Powers Consortium <br />Agreement from Washington County Housing and Redevelopment Authority, requesting the City <br />sign the Joint Powers Agreement which will allow HRA to conduct HOME funded projects in Lake <br />Elmo. Participation in this program requires no financial obligation from Lake Elmo nor does it <br />require any local administrative burden. <br />M/S/P Johnston/Mottaz - to direct the Mayor and Administrator to sign the Joint Powers <br />Consortium Agreement with Washington County HRA, and adopt Resolution 94-20. (Motion <br />passed 4-0.) <br />9. CITY COUNCIL REPORTS <br />A. Mayor John - On June 27, Mayor John attended a meeting of the Washington County <br />Finance Committee, to hear the proposed funding plans regarding the Oakdale golf course in <br />Sections 32 & 33. Mr. Craig Waldren, Oakdale City Administrator, outlined options: Tax <br />Increment Financing (TIF), in this case the County would receive no tax income until the TIF <br />expires; alternatively, a Soils Tax Increment District could be created, and again the County <br />would receive no tax income for 12 years. Oakdale proposed the City would dedicate 50% of the <br />new taxes generated by the new homes to be built around the golf course to offset some of the <br />land acquisition costs, and in this proposal the County would gain 50% of the taxes immediately <br />and receive the full tax benefit in 12 years. Mayor John stated that he gave his strong objection <br />to the proposal based on the fact that part of the property was in Lake Elmo, and Oakdale has not <br />made any approach to Lake Elmo on this matter, and also questioned worthiness of requesting <br />County support on a recreational project rather than for infrastructure. The meeting concluded <br />that the County's position would have to be researched and criteria drafted to define what type of <br />project would be eligible for this kind of funding. <br />B. Council Member Johnson - Reported that the brush pile at the Compost Site has been <br />chipped. Ceres Company quoted $2190, for "tub grinding", which took only two hours, and City <br />participation with the "front-end loader" was required. Council Member Johnson thanked the City <br />staff for getting quotes and getting the job done, and now there is a large pile of chipped brush for <br />mulch for the residents to take. <br />
