Lake Elmo City Council Minutes July 5, 1994 Page 6 <br />10. CITY ADMINISTRATOR'S REPORT <br />A. Resignation of Planning Commission Member, Vicki Horton <br />At its last meeting, the Planning Commission moved to recommend the code be amended to <br />require commission members receive their packets 3 working days before a meeting. The council <br />discussed the commission's motion. <br />MIS/P Johnson/John - to suggest to the Planning Commission that the date of the meetings be <br />changed to Tuesdays to allow for the 3 working days, and request a response from the <br />commission. (Motion passed 4-0.) <br />Administrator Kueffner suggested the council reduce the size of the Planning Commission to 9 <br />members. <br />MIS/ John/Mottaz - to amend the code to reduce the size of the Planning Commission to nine (9) <br />members - 7 full voting members and 2 alternates. <br />M/S/P Johnson/Johnston - to table the motion, due to the commission being made up of <br />volunteer residents, and request a response from Planning Commission before taking action to <br />amend the code in this way. (Motion passed 3-1, against: Mottaz.) <br />M/SIP Johnston/John - to accept the resignation of Vicki Horton from the Planning Commission, <br />and direct the City Administrator to send a letter to Vicki thanking her for her efforts, on behalf of <br />the City. (Motion passed 4-0.) <br />The council did not, at this time, move the 1 st Alternate on the Planning Commission to full voting <br />member, and will wait for a response from the commission regarding reducing the number of <br />commission members. <br />B. Request from Afton requesting support for reimbursement <br />of legal fees for Open Meeting Violations; and response from <br />League of Minnesota Cities. <br />The council received a copy of a Resolution, #1994-11 and a letter, received by the City on June <br />6, 1994, signed by two members of the Afton City Council requesting Lake Elmo adopt the <br />resolution to show support of Afton's efforts to get reimbursement for the legal fees incurred by <br />three council members accused of violating the open meeting law. The resolution directs the <br />League of Minnesota Cities Insurance Trust to comply with the Court of Appeals decision that the <br />LMCIT has a duty to defend City Council members. The council also received at letter, dated <br />June 15, 1994, from the LMCIT explaining their view on the issue. <br />
