LAKE ELMO CITY COUNCIL MINUTES AUGUST 2, 1994 <br />C. County Road 10 Mitigation <br />Larry Bohrer provided the council a report, dated July 29, 1994, on CSAH 10 Mitigation <br />Plan. The mitigation will be performed on Tom Armstrong's property adjacent to the <br />lake. In the agreement between the County and Armstrong, all material excavated from <br />the mitigation site is to remain on the Armstrong land and not hauled away. Three <br />different sites have been identified on the plan where this material is to be disposed of. <br />About 80,000 CY of soil that will be excavated for the mitigation, 20,000 CY of the more <br />suitable soil is intended to be spread south and east of the southerly storage building <br />and graded level. Approximate depth of fill at this location is 7 feet. The topsoil <br />material will be placed between the farmstead and the red brick Armstrong house south <br />of 15th Street. The remaining material will be placed south of the red brick house, west <br />of CSAH 13 and north of an existing field entrance. <br />Bohrer explained he brought up the grading and filling before the council because there <br />is no clear administrative procedure how to handle this kind of activity in the code. The <br />City can issue an excavation and grading permit and can attach whatever reasonable <br />conditions are appropriate to insure that the project is constructed in compliance with <br />concerns. <br />Council member Conlin pointed out if there is any changes to the landscape condition, <br />the CUP would have to be amended and resubmitted to the city. She voiced her <br />concern on the 7' depth of fill at this location which would cause the outside storage to <br />be more visible. Mottaz and John voiced their concern on stockpiling. There were no <br />concerns on the other two designated sites (topsoil area and agricultural area) <br />Filla stated if it appears as though this project will impact a condition of the existing <br />permit then it has to come back to the council. Don Theisen said the county was not <br />aware of the CUP when they were making a deal with Mr. Armstrong. <br />M/S/P Mottaz/John - that the city engineer and attorney study this proposal in relation <br />to the CUP and make recommendations to city council by August 16, as to what <br />permits are necessary and what contingencies are required. (Motion passed 5-0). <br />D. County Road 10-Reconstruction Update (Washington County) <br />Don Theisen, Washington County Public Works, reported bids have been opened and <br />they have a low bidder of $3,025,000 with Forest Lake Contracting. The County's <br />share is $2.7 million, Oakdale share is $230,000, and the other $70,000 is MnDOT for <br />signals. Bid award and preconstruction conference is scheduled for August 9 at <br />Washington County Public Works.. <br />
