LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 21, 1995 5 <br />M/S/P Johnston/John - to approve Resolutions 95-13 through 95-22 receiving feasibility <br />( reports and call a public hearing for March 9, 1995 to review the 1995 overlay projects <br />with inclusion of striping cost on the designated roads as recommended by the Parks <br />Commission as an informational item at the March 7, 1995 council meeting. (Motion <br />passed 5-0). <br />Councilman Hunt is a property owner on the list for street improvements and asked if <br />he should abstain from voting. Filla responded that a conflict of interest deals primarily <br />with contracts and having a financial interest. Filla will contact the League of Minnesota <br />Cities for more information. <br />B. Further discussion on Lake Elmo/Oakdale Joint Sewer Project <br />Larry Bohrer explained in his report dated February 17, 1995 that an agreement <br />between Lake Elmo and Oakdale to settle the Section 32/33 issues has been executed. <br />One of the provisions of the agreement is a joint sanitary sewer construction. project, <br />provided such project is feasible and cost effective. In all of the joint meetings I have <br />attended, Oakdale is willing to cooperate in a joint project provided two conditions are <br />met: <br />1. The joint project will not cost Oakdale any more in first cost than a "stand alone" <br />system. <br />2. The joint project will not cause delay in Oakdale's current projects. The first project <br />is under construction now with a second project scheduled for this summer. The lift <br />station is scheduled for 1996. <br />In an effort to determine the best course of action regarding a joint construction project, <br />we have prepared up-to-date cost estimates based on the latest information available. <br />The purpose of this letter is to determine Oakdale's base cost for a stand-alone system <br />and then compare that cost to various joint projects to determine Lake Elmo's cost. <br />M/S/P Hunt/Conlin - to direct the city engineer to work with the city administrator to <br />update the 1992 440 MUSA application and arrange appropriate hearings as required <br />to prepare for submission of the application to the Metropolitan Council as expeditiously <br />as possible and to pass along our favor of Option 2-Lake Elmo Independent System to <br />the City of Oakdale. (Motion passed 5-0). <br />8. CITY ATTORNEY'S REPORT: <br />Attorney Filla reported that a week ago Friday Federal Land argued that Judge <br />Doyscher's order allowed them to submit any proposal for review under the 1979 plan <br />and the 1994 proposal was substantially the same as the 1980-87 proposal. The city <br />argued that under Doyscher's order it did not allow them to submit any proposal that <br />allowed them to resubmit the 1980/87 proposal and the 1994 proposal was <br />
