Silver, Of Counsel <br />BY FACSIMILE <br />AND U.S. MAIL <br />Conflicts of interest arise when Council Members have a <br />financial interest in a contract which is awarded by the City. <br />Minnesota Statute §471.87 provides as follows: <br />Except as authorized in 5471.88, a public officer who is <br />authorized to take part in any manner in making any sale, <br />lease, or contract in an official capacity shall not <br />voluntarily have a personal financial interest in that <br />sale, lease or contract or personally benefit financially <br />therefrom. Every public officer who violates this <br />provision is guilty of a gross misdemeanor. <br />The award of a street improvement contract by the City Council <br />would not create a conflict of interest for a Council Member unless <br />that Council Member had an ownership interest in the company which <br />was awarded the contract.
