LAKE ELMO CITY COUNCIL MINUTES MARCH 4, 1996 3 <br />M/S/P John/DeLapp - to direct the staff to send a letter to the Oakdale City Council expressing Lake <br />Elmo's concerns in relation to the discharge of this pipeline from other areas other than Olson Lakes <br />Estates Pond and request they restrict both flow and volume to predevelopment rates. (Motion passed 4- <br />0). <br />5. CONSENT AGENDA: None <br />6. UNFINISHED BUSINESS: <br />A. Assessment Policy:County Road 13 Project; Road Utility <br />Administrator Kueff nor provided a draft of an assessment policy dated October 3, 1995. The City's policy <br />In the past has been to assess on a per unit basis. Included in the draft assessment policy is the <br />statement: "The City will assess properties along County roadways as if they were City streets." This <br />was inserted because the County informed Lake Elmo during its County Road 13 presentation, that City <br />participation was required based on its newly adopted improvement policy. <br />Mayor John and Councilor Hunt favored the assessment policy and asked that the City attorney and <br />engineer review it and submit their comments. Councilman Del-app requested that the cost and <br />maintaining street lights be addressed in this policy. <br />M/S/P Hunt/Johnston - to ask the City Attorney and Engineer to review the draft assessment policy and <br />respond with comments at the next City Council meeting. (Motion passed 4-0). <br />The Council received a copy of Mayor John's memo, dated November 6,1995, regarding a road utility. <br />Mayor John felt it was time to consider setting up a City wide street maintenance utility. It is less likely to <br />generate the personal conflicts and will involve an annual assessment which would be a more palatable <br />amount. <br />M/S/P Hunt/DeLapp - to direct the City Engineer and staff to study the feasibility of a road utility and also <br />compare a set yearly budgeted item for road maintenance and report back to the Council. (Motion <br />passed 4-0). <br />M/S/P Hunt/John - to direct the City Administrator to send a letter to Washington County Staff, Don <br />Theisen, Chris Thornton, expressing the City's position that the County should at least be liable for one <br />assessment based on the fact that there is access of County Rd 13 to the Lake Elmo Regional Park. <br />(Motion passed 4-0). <br />B. Leonard Hanson property on Hudson Blvd. <br />Planner Terwedo reported she talked to Len Hanson, today, and he would not be able to attend the <br />Council meeting tonight. <br />M/S/P Hunt/John - recognizing the fact that Len Hanson would not be able to attend the Council meeting, <br />therefore, for his benefit, the Council is postponing consideration of this agenda item until the March 19 <br />Council meeting when the Council intends to take action and request that Mr. Hanson attends. (Motion <br />passed 4-0). <br />C. Berschen property rezoning from RR to PF; response to petition for EAW <br />Lake Elmo residents, James Blackford and Onno VanDemmeltraadt indicated an EAW is necessary to <br />address several issues including noise, smell, dust and surface water runoff. Larry Bohrer, City <br />Engineer, has reviewed the information submitted by residents supporting their request for an <br />Environmental Assessment Worksheet prior to the rezoning of the Berschen property. According to <br />Bohrer, there is no evidence that these factors would create a significant environmental impact. <br />
