LAKE ELMO CITY COUNCIL MINUTES MARCH 4, 1996 4 <br />Jim Blackford expressed a concern about the potential for leaks from fuel tanks. He presented reports <br />that in the past few years 38 underground tanks leaked at public work facilities in Minnesota. The Lake <br />Elmo site will only have above ground fuel storage tanks set in concrete spill containment basins in case <br />of a leak. Council member Johnston said the maintenance department currently has above ground tanks <br />which are monitored about four times a year by the MPCA and have never had a problem. <br />M/S/P Hunt/John - to deny the Petition for an EAW for the new public works facility (Berschens Site) <br />based upon the following findings and because the Petition and the evidence presented by the Petitioners <br />does not demonstrate that the project will have the potential for significant environmental effects: <br />1. The project, as revised: <br />a. will be located on approximately fifteen (15) acres of land; <br />b. will consist of a public works facility with a gross floor building area of approximately 10,000 sq.ft.; <br />c. will not include any composting; and <br />d. will require above -ground fuel storage tanks set in concrete, spill containment basins which <br />will hold the entire volume of the tank should a leak occur. <br />2. The project does not meet or exceed any of the thresholds for a mandatory EAW. <br />3. If a public works facility is considered an institutional facility, the project is exempt from the <br />requirements of an EAW pursuant to MR 4410.4600, Subpart 10A1. <br />4. Petitioners have not submitted any facts which would indicate that the project will have an <br />adverse impact on water quality, loss of farm land, traffic, noise or air pollution. <br />5. The project will be constructed in accordance with the City's development regulations. <br />6. The access to the site from public roadways will be designed in accordance with MNDOT <br />Road Design Manual I and the safety criteria contained therein. (Motion passed 4-0). <br />7. PARKS/MAINTENANCE DEPARTMENT: <br />A. Discussion of Recreational Facility in Sunfish Park <br />Parks Supervisor, Mike Bouthilet, reported the Parks Commission is looking at areas in the City to <br />expand outdoor ice rinks. The Commission has looked at a`boncept for hockey rinks and a ski shelter for <br />Sunfish Lake Park to be put in their CIP. The question was raised by the Council regarding the initial Park <br />Bond issue that was used to purchase the land and if we can make these amendments to the Master <br />Park Plan. <br />In the February 26, 1996 Parks minutes, the commission discussed an ice rink in DeMontreville Park and <br />will look for a suitable location on the spring walk-thru of DeMontreville Park. Kes Tautvydas, Parks <br />Chair, explained the commission has looked at the area in DeMontreville and without some major <br />modifications of the surface, could not simply flood an area that exists now. They considered Sunfish <br />Lake because it was more appropriate and centrally located for the community. <br />In principal, the Council felt that all the proposed activities should be the subject of a neighborhood <br />petition or a grand number of residents requesting establishment of this kind of facility. A host of people <br />have not come in asking for this type of facility be provided in Lake Elmo. The Council agreed with the <br />concept, but questioned if the City can do this because of Lawcon grants used for the development of <br />Sunfish Lake Park. The Council encouraged the Parks Commission to continue with studies for such a <br />facility. <br />
