The water consumed by Lake Elmo shall be measured by a master meter, <br />furnished and constructed by Lake Ehno, and shall be owned and maintained by Oakdale at its <br />own cost and expense. The meter shall be of suitable make and setting and shall be installed and <br />housed properly, all subject to approval of both cities. Such meter shall be subject to periodic <br />testing by Oakdale, the results of which shall be made available to Lake Elmo, and Lake Elmo <br />may test the meter at any reasonable time but at the sole expense of Lake Elmo. If the meter <br />reading is within 5% of the actual water used, the meter shall be considered suitable. If the meter <br />reading is not within 591c of the actual water used the meter shall be replaced at Oakdale's <br />expense. If Lake Elmo requests a new meter, and the reason for the new meter is reasonable, a <br />new meter shall be installed but at the sole expense of Lake Elmo. <br />4. SIMPLEMENTAL UPPLY <br />Lake Elmo reserves the right to supplement its water supply with any supply <br />approved by the Minnesota State Board of Health, provided that no such supplemental water will <br />be allowed to enter the water system of Oakdale and any connection or transmission of <br />supplemental water through mains transmitting water purchased from Oakdale shall be subject to <br />approval of Oakdale, provided however that such approval shall not be arbitrarily withheld. <br />5. CONNECTIONS BEYOND SERVICE AREA IN LAKE ELMO <br />Any requests for connections beyond the service area must be forwarded to \' <br />Oakdale through the Lake Elmo Administrator. The requests must also be accompanied by <br />information regarding the maximum potential number of connectors anticipated through a service <br />extension and an estimate of the capacity required to service those areas. Any water extension <br />beyond the SE 1/4 of Section 33 shall require an amendment to this Agreement or a new <br />agreement. <br />A. The rate charged to Lake Elmo will be equal to the consumption rate <br />charged to Oakdale residents. A 30 day prior written notice will be given by Oakdale to Lake <br />Elmo of any increases in the water rates. <br />B. The meter will be read on or before the 5th day of each month, the bill will <br />be mailed on or before the 10th day of each month with payments due on or before the 30th day <br />of each month. <br />-3- <br />f <br />
