LAKE ELMO CITY COUNCIL MINUTES JUNE 18, 1996 <br />M/S/P Hunt/Del-app - to accept the Parks Commission recommendation on Kleis Park Infield Installation <br />and shrub removal around playground oak trees. (Motion passed 5-0). <br />B. Playground equipment recommendation for Kleis and Pebble Park <br />At their June 17, 1996 meeting, the Parks Commission recommended the Council accept the bid <br />submitted by Gametime for Kleis and Pebble Parks based on it will be consistent with the other <br />playground equipment purchased so far, easier installation, and the commission is impressed with their <br />proposal, and also recommended Mike Bouthilet negotiate for an upgrade to the powerscape equipment <br />(slightly more durable/beefy) for Pebble Park for the same price for a total price of $35,000 for both sets <br />M/S/P Johnston/Hunt - to accept the Parks Commission recommendation on accepting the bid submitted <br />by Gametime for playground equipment at Pebble Park and ask Mike Bouthilet to negotiate for an <br />upgrade to the powerscape equipment for the same price for a total price of $35,000 for both sets. <br />(Motion passed 5-0). <br />C. Parks Recommendation on placement of antenna in Pebble Park <br />The Parks Commission discussed the proposal by SBA to place an antenna tower in Pebble Park and <br />recommended the Council deny the request of SBA to construct an antenna tower in Pebble Park, or in <br />any public park, for safety and aesthetic reasons. Kes Tautvydas, Parks Commission Chair, explained <br />the Commission is strongly opposed to antenna towers in any park because people should be able to <br />enjoy nature without having to view constraints and a tower would detract from the park. <br />VFW BALLFIELD: <br />Administrator Kueffner talked to Barb Haacke who was going to get back to her on the donation from the <br />Lake Elmo Jaycees. The Administrator will contact the Realtor about the (bottom line) selling price of the <br />ballfield. <br />D. Annual Report by Fire Department, Minor By -Law Changes <br />Fire Chief Richard Sachs presented the 1995 Fire Department Annual Report. <br />M/S/P Johnston/Del-app - to accept the 1995 Fire Department's Annual Report. (Motion passed 5-0) <br />Chief Sachs explained the Department has made a change to its by-laws. They have changed the rate of <br />pay for probationary members and members that are not currently at the level of First Responder. <br />M/S/P Johnston/Conlin - to approve the change to Article VI -Compensation of the Lake Elmo Fire <br />Department By -Laws. (Motion passed 5-0). <br />9. CITY ATTORNEY'S REPORT <br />The City received a letter from Bannigan & Kelly, P.A., who represent a group of Lake Elmo residents <br />concerned with certain land use matters currently pending before the Council. Attorney Filla will respond <br />directly to Attorney Hanton in more detail: Section 301.060E. of the City code does not apply to requests <br />for legislative changes submitted by property owners, disagrees Section 15.99 of the State Statute refers <br />to anything other than zoning matters relating to development and doesn't apply to the facts of this <br />particular case <br />M/S/P John/Johnston - to direct Attorney Filla to prepare a response to this letter as described at the <br />meeting.
