LAKE ELMO CITY COUNCIL MINUTES JULY 16, 1996 6 <br />8. _PLANNING LAND USE & ZONING: <br />A. Declaration of Restrictions: Mike Severin <br />M/S/P Johnston/Conlin - to approve the Declaration of Restrictions for the property at 8012 50th Street <br />owned by Michael Severin. (Motion passed 5-0). <br />B. (1) PUBLIC HEARING: Case No. VAR/96: Variance to standards in the Limited Business Zoning <br />District <br />(2) Case No. CUP/96-22 Resolution granting a Conditional Use Permit for construction of 7500 <br />square foot woodworking shop and office building in Limited Business Zoning District, Applicant: Walt <br />Pechan, 8603 N. 34th Street <br />Planner Terwedo asked that this item be postponed because there are drainage issues that need to <br />resolved. Watt Pechan has consented to this delay. <br />M/S/P Conlin/DeLapp - to postpone until the August 6th meeting in order for the drainage issue to be <br />resolved <br />C. Case No. PR/96-12: Site and Plan Review: 8,000 square foot office building on Lot 4, Block 1, <br />Brockman 1st Add. Applicant: George I. Middleton <br />Steve Bachman, representative of Retail Construction Services, presented a site and plan review for <br />construction of a 8,000 gross square foot office building for a single use company. The 3 acre site is <br />located in the General Business Zoning District. <br />M/S/P Johnston/Hunt - to approve Case No. PR/96-12, a site and plan review for an 8,000 sq.ft. office <br />building on Lot 4, Block 1, Brockman 1st Add. as requested by Retail Construction Services; subject to <br />the seven conditions stated in the City Planner's Report dated July 16, 1996. (Motion passed 5-0). <br />D. Case No. ZAM/SUB/96-20: Ordinance amending Comprehensive Plan and Zoning Map: <br />Resolution approving a minor subdivision. Applicant: Ed Gorman, Lot 15 and 16 County Auditors Plat <br />#8 <br />On June 4, 1996, the Council approved a variance to lot width on a public street. As part of that <br />approval, the Council required that an additional .29 acres of land be added to the lot so a variance would <br />not be required to the lot size. In order to add the .29 acres to the .61 acre parcel, a minor subdivision is <br />required and a rezoning is also required. <br />M/S/P Johnston/Conlin - to adopt Resolution No. 96-16, A Resolution Granting a Minor Subdivision to Ed <br />Gorman and Kathy Gorman on Lot 15 an 16 County Auditor's Plat #8. (Motion passed 5-0). <br />M/S/P Johnston/Conlin - to adopt Ordinance 8138, An Ordinance amending Section 301.070 C "Zoning <br />District Map" of the 1979 Lake Elmo Municipal Code designating that part of Lot 1, County Auditor's Plat <br />No. 8 as shown on the map as R1 zoning, Single Family Residential. (Motion passed 5-0). <br />E. Case No. SUB/96-24: Resolution approving a minor subdivision. Applicant: Mel and Jane Eder, <br />property located at northwest corner of Keats and Julep Avenue <br />Mel and Jane Eder are requesting subdividing a 5.24 acre parcel and combine it with an existing 5.24 <br />acre to create a 10.48 acre parcel. The area is zoned Rural Residential and the 10.48 acre parcel is <br />consistent with this zoning district. No additional lots are being created. The Planning Commission <br />unanimously recommended approval of this minor subdivision. <br />
