LAKE ELMO CITY COUNCIL MINUTES JULY 16, 1996 <br />M/S/P Hunt/Conlin - to adopt Resolution No. 96-17, A Resolution Granting a Minor Subdivision to Melvin <br />and Jane Eder. (Motion passed 5-0). <br />F. Case No. ZAT/96 Ordinance amending Section 301.120 A.1 of the Lake Elmo Municipal Code <br />relating to antenna towers on existing water towers. <br />The Council directed the staff to prepare an amendment to the Code relating to towers/antennas. This is <br />in response to numerous inquires to place antennas to existing public and private water towers, in public <br />parks, and on buildings. On July 8 the Planning Commission held a public hearing and recommended <br />approval of the proposed amendment limiting the use of antennas to existing water towers only. <br />M/S/P Conlin/DeLapp - to adopt Ordinance 8139, An Ordinance Amending Section 301.120 A.1. of the <br />Lake Elmo Municipal Code relating to Height of Antennas on Towers. (Motion passed 5-0). <br />M/S/P Hunt/John - that the staff and Planning Commission be directed to review, with no time limit for <br />completion, the technical aspects of antenna towers elsewhere and obtain expertise and prepare a <br />recommendation on advisability and placement of antennas in the City. The Commission was asked to <br />look at the model ordinance, review technical aspect, obtain ordinance from other cities and develop a <br />model ordinance. (Motion passed 5-0). <br />G. Case No. ZAT/96 Ordinance amending Section 1507 of the Lake Elmo Municipal Code relating to <br />hours of operation for construction equipment (ITEM DELETED) <br />H. 1-94 Financial Services and 1-94 Update <br />City Planner Terwedo met with Paul Donna Springsted, to discuss the City's need for a fiscal impact <br />study of growth. Based on their discussion, Springsted prepared a proposal for professional financial <br />services with a quote of $11,850. The City has budgeted $45,000 for consulting services in the Planning <br />Budget for 1996. The purpose of the study is to analyze the fiscal impact of three land -use development <br />growth scenarios. It is anticipated that the findings of this study will be incorporated into Lake Elmo's <br />overall planning efforts for the 1-94 corridor. <br />M/S/P DeLapp/Conlin - to postpone discussion on this issue after the 1-94 Task Force meeting scheduled <br />for July 30th with this item placed on the August 6th Council meeting. (Motion passed 5-0). <br />I. Process for Open Space Applications <br />City Planner Terwedo reported the sewer ordinance is not in place and she has met with three <br />developers who have been working with the Land Trust for easements. The Met Council has until August <br />16, 1996 to review the Comprehensive Plan Amendment and the Open Space Ordinance does not <br />become effective until it is published. Council DeLapp felt that the road widths were transcribed wrong <br />and will work with the staff to go over the tape of May 21, 1996 council meeting. <br />9. UNFINISHED BUSINESS:NONE <br />10. CITY ATTORNEY'$ REPORT: <br />Attorney Filla gave an update on the Junker Landfill Trust. <br />11. CONSENT AGENDA: <br />A. Non -intoxicating malt liquor license for Huff n'Puff Days <br />M/S/P Johnston/Hunt - to grant a non -intoxicating malt liquor license to the Lake Elmo Jaycees for <br />Huff'N Puff Days, August 8-11, 1996 and to waive the $100 license fee. (Motion passed 5-0). <br />
