LAKE ELMO CITY COUNL MINUTES JANUARY 7, 1997 <br />D. Resolution No. 97-1 Authorizing Signature for Payment of Funds from Lake Elmo Bank <br />The City must notify the local depositories when there has been a change in the name of those <br />authorized to sign checks on behalf of the City. There has been no change in the names of <br />those authorized to sign checks on behalf of the City, but there has been an election and a formal <br />resolution confirming that authorization should be adopted to prevent any misunderstanding. <br />M/S/P DeLapp/Conlin - to adopt Resolution No. 97-1, A Resolution Designating Official City <br />Depository, and Authorizing Signatures for Payment of Funds from Lake Elmo Bank. (Motion <br />passed 5-0). <br />E. Appointment of City Engineer <br />The Council received a letter of interest from Tom Prow, TKDA, and from HDR who offered <br />specialized services to the City, particularly an innovative new method of treating on -site sewage. <br />Council members Hunt and DeLapp were impressed with a recent HDR presentation and that <br />some of the company's techniques would be useful in managing water resources for cluster <br />housing development. Hunt suggested that the City stay with TKDA, but solicit the management <br />experts for additional help. Mayor John and Council member Conlin agreed that although they <br />were impressed with HDR they urged the City to stick with TKDA because they have been <br />satisfied with TKDA's long track record with the City. Council member Dunn also agreed TKDA <br />has been good over the years, but the City needs to keep on top of new technologies. If we need <br />to outsource for some of this, we could work around that. TKDA Vice President, Dick Sobtech, <br />plead his company's case and vowed that TKDA would successfully pursue any water <br />management strategies the Council requests. He stated that TKDA has been on the leading <br />edge, and it would provide that leading edge service. <br />M/S/P Conlin/Hunt - to appoint Tom Prow, TKDA, as the City Consulting Engineer for 1997. <br />(Motion passed 5-0). <br />F. Appointment of City Attorney <br />Jerry Filla, Peterson, From & Bergman, has indicated a desire to be reappointed as the City <br />Attorney for both prosecutions and civil matters. Council member Dunn questioned what she <br />called exorbitant legal fees charged to the City in recent years. The City's legal budget has <br />steadily increased from roughly $67,700 in 1994 to $80,000 in 1996 and stressed her desire to <br />see the Council cut expenses. In response, Filla explained that since 1992, there has been an <br />accompanying four -fold increase in criminal prosecution in the City (97 criminal events were <br />taken to court in 1992 where there were 458 events in 1996), Administrator Kueff nor explained <br />that in 1992, the City received an average of $500 per month in fines, while in 1996 that average <br />was $3,600. <br />M/S/P Hunt/Conlin - to appoint Jerry Filla of Peterson, Fram & Bergmann as the City Attorney for <br />prosecution and civil matters for 1997. (Motion passed 4-1:Dunn:Would like the Council to cut <br />expenses so the City can meet their 1997 budget of $70,000). <br />G. Appointment of Financial Advisor <br />Paul Donna, Springsted Company, indicated its desire to be reappointed as the City's Financial <br />Consultant for 1997. Staff recommends reappointment of Springsted as the City's financial <br />advisor. <br />M/S/P Dunn/DeLapp - to appoint Springsted Company as the City's financial advisors for 1997. <br />(Motion passed 5-0). <br />
