C. Staff pay increases <br />Administrator Kueffner provided a copy of the 1997 Pay Schedule that was reviewed in preparation of the <br />1997 budget. Councilor DeLapp suggested the Council meet with the staff and review the comments made <br />by their supervisor and see if they have any objections and give them an opportunity to bring up issues for <br />discussion. <br />M/S/P Hunt/Dunn — to postpone staff pay increases until the Council can work with the City Administrator <br />on pay reviews and raises. (Motion passed 5-0). <br />M/S/P DeLapp/Hunt — to establish a workshop with the Council/City Administrator and interested staff <br />members on September 24, 6 p.m. to work with the Administrator on employee reviews and pay increases. <br />(Motion passed 5-0). <br />7. PLANNING, LAND USE AND ZONING: <br />A. Request from Steven Weber for clarification of zoning regulations <br />Steven Weber's father purchased 5 acres on Lake Elmo Avenue (just south of Highway 36) approximately <br />20 years ago. This lot was permitted when our Rural Residential zoning district required only five acres. <br />The Future Land Use Map shows this area as (RED) Rural Estates Density. Because of the odd <br />configuration of the lot, Mr. Weber feels that half of the lot is unusable and that the City should permit him <br />to subdivide. Steven Weber would like to buy 2.5 acres from his father and build a home. The Council <br />considered this a request for clarification of a zoning regulation and this particular section of the City is <br />zoned Rural Residential which requires 10 acre lots. If he was going to develop the property, the Future <br />Land Use Map show this property as Rural Estates zoning which requires 20 acres. The City would have to <br />change the comprehensive plan, change the zoning requirements, and grant a minor subdivision with a <br />variance because it can't meet the 2.5 acre minimum according to the ordinance. <br />M/S/P Hum/DeLapp — that the Council consensus is not to do anything; to not change the lot size, but keep <br />our 10 acre lot requirement in RR zoning in the code book; that granting this request would allow a legal <br />non -conforming lot to become further non -conforming. (Motion passed 4-1:Dunn:these odd size lots <br />should have been identified during the moratorium when the entire City was studied, would like to have the <br />option of creating 2.5 acre lots.) <br />B. Ordinance rezoning from RR to OP: Applicants: William McCully and R-Properties <br />(Hamlet Estates) <br />This is a zoning map amendment requested by R-Property/William McCully to rezone a 56 acre parcel of <br />land form Rural Residential to Open Space Preservation District. The zoning request is in conjunction with <br />the concept plan for Hamlet Estates located north of State Highway 5, west of Beaut Crest. This parcel of <br />land has been identified on the Future Land Us Map as an Open Space Development Area. <br />M/S/P DeLapp/Hunt — to adopt Ordinance No. 9715, An Ordinance amending Section 300,07 of the <br />Zoning District Map of the 1997 Lake Elmo Municipal Code rezoning 56 acres from Rural Residential to <br />Open Space Development requested by R-Property/William McCully, located north of State Highway 5, <br />west of Beaut Crest, based on the Findings of Fact listed in the City Planner's Review, recommendation of <br />approval by the Planning Commission and the rezoning is consistent with the comprehensive plan and <br />zoning regulations. (Motion passed 5-0). <br />C. Concept Plan (Hamlet Estates) <br />Planner Terwedo reported the concept plan for Lake Elmo Hamlet Estates, located north of State Highway <br />5 and east of Beaut Crest, consists of 26 lots (26.65) which is calculated on 57 acres. Washington County <br />records show 58 acres. Some family lots are oriented on a village green; therefore, a density bonus for the <br />development of a village green. The proposal indicates an open space area along Highway 5.
