Oakdale has been notified regarding <br />amending the water agreement to provide water service to the site. There's about 9 acres in the proposed <br />lake area which will range in depth from 2' to 12'. Goal is to maintain water quality. Planner Terwedo <br />reported Rehbein has kept in contact with the Soil Water and Conservation District as stated in letter dated <br />April 28, 1997 regarding the creation of the wetland. The wetland will be built in two seasons, and <br />Terwedo stated strict timelines could be placed in that the development would not occur until completion of <br />the wetland creation. The homeowners Association would be responsible for the pond. <br />M/S/P Hum/DeLapp — to approve Case No. OPC/97-26 with the City Planner's Recommendation and the <br />Planning Commission Recommendation as presented with the additional conditions of alerting the new <br />buyers of the existing crematorium and possible expansion, clarification of allowable density (25 or 26 lots) <br />involved depending on final survey, including staff direction to contact the City of Oakdale regarding an <br />amendment to the water agreement and to work with Rehbein Co. on acceptable conditions for the grading <br />permit as listed on page 3 of the City Planner's report. (Motion passed 3-2:Dunn: Has a concern on density <br />bonus, the concept plan might meet the Open Space Ordinance, but is not in the spirit of Lake Elmo to have <br />such dense development, there isn't anything in place to monitor the wetland treatment system; Conlin <br />believes in the #5 condition: No density bonus be given for the village green, the water amenity has been <br />expanded for surface water runoff for other properties and does not want to burden the Home Owner's <br />Association with the responsibility of maintaining the pond). <br />D. Site and Plan Review: Lake Elmo Bank <br />Roger Knutson, Lake Elmo Bank, is requesting to increase the number of parking stalls by 31. There are <br />currently 78 parking spaces. There is no lighting proposed. Additional landscaping included around the <br />parking area adjacent to the pond around the north perimeter was added as a condition of approval. <br />Drainage has been approved by the City Engineer. When lot 2 is developed, the impervious surface <br />calculation will be based on 7.86 acres. <br />M/S/P Hunt/Conlin — to approve Case No. SP/97-46 Site and Plan Review for the development of 31 <br />additional parking spaces for the Lake Elmo Bank based on the 4 conditions of approval as amended and <br />based on the Findings stated in the City Planner's Review and the Planning Commission's approval.. <br />(Motion passed 5-0). <br />E. Railroad Right -of -Way (Timeline) - Informational <br />The Council agreed with a letter from Attorney Filla, dated August 21, 1997, recommending the City <br />request Mr. Johnson provide the City with copies of the deeds of conveyance which he received from the <br />railroad company for any right-of-way which was vacated by the railroad and the City contact the railway <br />company directly and advise them that we would like to be made aware of any plans they may have to sell <br />future right-of-ways within the City and indite the City would expect any purchasers of railway property to <br />comply with the City's zoning and subdivision regulations. <br />F. Set date and time for joint City Council Planning Commission meeting to discuss OP regulations. <br />The City Council will hold a joint meeting with the PZ on Monday, September 8, 1997 5:00 p.m. City Hall. <br />G.
