M/S/P Hunt/DeLapp — to adopt Resolution No. 98-24, receiving the Feasibility Report for the Overlay of <br />Hill Trail N. and to call a public hearing on said improvement for May 5, 1998 at 7:00 p.m. (Motion <br />passed 4-0). <br />7. MAINTENANCE/PARKS/FIRE: <br />A. Ordinance amending Section 600 of Lake Elmo Code; Conversion from Touch Pads to Radio <br />Reads <br />Administrator Kueffner reported that the Finance Director was not aware of the December 2, 1997 proposal <br />made by Ed Wiegert and asked for postponement. The Council received a DRAFT revision to Section 600 <br />of the Lake Elmo Municipal Code relating to Water <br />M/S/P Johnston/DeLapp — to direct the staff to prepare the appropriate ordinance reflecting changes to <br />Section 600 of the Lake Elmo Municipal Code. (Motion passed 4-0). <br />8. PLANNING, LAND USE AND ZONING: <br />A. PUBLIC HEARING: (After -the fact) Grading Permit: Boris Beckert, 3036 Inwood Avenue N. <br />City Planner Terwedo reported the grading application, as submitted, indicated that Boris Beckert, 3036 <br />Inwood Avenue N., has moved 450 cubic yards of fill to create a berm along the south property line and to <br />the north of the entrance drive. As viewed from a home in Beau -Haven, the berms are a steep shelf, which <br />have impacted the view of the north and are a harsh visual impact to the area. The City Engineer has <br />reviewed the plan and commented on the drainage issue in his memo dated March 5,1998. <br />Mayor John opened up the public hearing at 8:30 p.m. in the Council chambers. <br />Boris Beckert, with the help of architect, Todd Drescher, explained the project is not complete and is being <br />worked on in a step -like fashion. The berms would be broken down, would not cause any drainage <br />problems or ponding on the adjacent property to the South. Yardmaster provided a landscape diagram <br />showing where they would plant prairie seed mix and wildflowers. This would look like a rolling prairie lot <br />and would increase property values. According to the way he interprets the Code, a public hearing was not <br />necessary because they were only moving 450 cubic yards over a 4.3-acre site. <br />Burt Price, 8384 Stillwater Blvd., (adjacent property owner to the South), indicated Mr. Beckert <br />constricted the berms without a permit, the beans were very abrubt, ugly, and changed the natural flow of <br />water and forced water to stay on his property. This would decrease his property value. He could not see <br />any purpose served by the berms and asked to have them removed. <br />Brad Krank, 3082 Inwood Avenue N., stated, as a neighbor, he had no objections to the project and no <br />problem with the berms. <br />Mayor John closed the public hearing at 9:10 p.m. <br />Mr. Beckert and Mr. Price indicated they would work toward an agreement requiring the berms to be cut <br />down, the natural drainage not blocked by the berms, and no pending on the adjacent property to the south. <br />M/S/P Hunt/DeLapp — to postpone consideration of a grading permit for Boris Beckert, 3036 Inwood <br />Avenue N., until such time the City Administrator arrange a meeting with staff and interested parties to <br />settle the differences and come up with an amicable agreement and then bring back to the Council. <br />(Motion passed 4-0). <br />B. Grading Permit for Wildflower Shores: Rehbein <br />City Planner Terwedo reported the City approved the preliminary plat and plan for Wildflower Shores on <br />March 2, 1998. An element of the plan is the creation of a pond area located on the southwest portion of <br />the site. This pond will be both a stormwater detention area and eventually a wetland.
