2 <br />MSP (Malvin /Johnson) To rescind Resolution #397 passed at the September 9th <br />council meeting. <br />MSP (Rustad/Malvin) Approving Resolution #397 apportioning the assessments on <br />the Barth Wakiriak Addition, Division #39252. <br />MSP (Rustad /Johnson) Approving Resolution #398, an abatement of assessments <br />on Lot 11, Knollwood Park Addition totaling $217.57. Abatement has arisen as <br />a result of lot division #38761. <br />Clerk's office will be open until 9:00 P.M. October 11th, 14th, and 15th for <br />voter registration purposes. Any interested parties who would like to work <br />as an election judge or counter should contact Rosemary Goff if their party <br />affiliation is Democrat or Fred Goff if their party affiliation is Republican. <br />Councilman Malvin's Report: <br />No report. <br />Councilman Johnson's Report: <br />Councilman Johnson read the B E report for July and August. <br />Councilman Lang's Report: <br />Councilman Lang summarized the Parks and Playground Committee minutes of <br />September 18th. <br />Meeting adjourned at 8:30 P.M. for rezoning hearing. <br />Legal Notice <br />Parcel (1) except the N 150' of Lot 59, Auditors Subdivision #89, R1 (residential) <br />to R3 (multiple dwelling). Parcel (2) except the W 100' lying Northerly or <br />Southerly 514.63' of Lot 58, Auditors Subdivision #89, B3 (general business) to <br />R3 (multiple dwelling). Legal notice was published in the New Brighton Bulletin <br />September 12th and September 19th. Deputy Clerk read the legal notice and <br />attested to publication and notification of property owners. Notices mailed <br />September 13th affecting 25 parcels. <br />Petitioners Dennis Evavold and Dan Vaughn arrived three minutes late. A proposed <br />layout was presented which included two 23 unit buildings and one 17 unit building, <br />pool and garage included. One bedroom unit 700 square feet, two bedroom unit <br />1,000 square feet. Mrs. Patrick Burns requested information on location of <br />proposed development. Mr. Ernest Johnson requested information on parking and <br />price of units. Two bedroom unit $175 and one bedroom unit $155. Fire Chief <br />Fagestrom wished to know if hydrants and an adequate driveway were provided. <br />Mayor Rustad called for objections and for those in favor of the proposal. <br />Mr. Leo Huot, was against the proposal. He said the area should be residential. <br />He then presented a petition against. Mr. Glen Hanson objects on the same basis. <br />Mr. Patrick Burns objects on the same basis. Mr. Dan Vaughn spoke in favor of <br />rezoning. Sa}c many in favor but no names obtained. He said he believes people <br />that are in favor generally do not shoe up at rezoning hearings. Attorney Meyers <br />then read permitted uses in B3 zoning. Attorney Meyers stated 8 names on petition <br />were on abstract and 25 parcels on abstract. Mayor Rustad stated hearing was <br />closed. Councilman Malvin and Lang advised residents decision would be final <br />and that anything could go in and little could be said under the B3 zoning. <br />MSP (Malvin/Lang) To approve the rezoning. Johnson Ave, Lang Aye,Maivin Aye, <br />Rustad Nave. Rezoning failed. <br />
