3 <br />9:00 P.M. Rezoning hearing requested by Odell Peterson called to order. <br />Legal Notice <br />Lot 13 and the N 250' of Lot 14, Knollwood Park Addition, R1 (residential) to <br />R3 (multiple dwelling). Deputy Clerk read legal notice and attested to <br />publication in the New Brighton Bulletin September 12th and September 19th. <br />The legal notices were mailed September 13th affecting approximately 19 parcels. <br />Douglas Johnson presented the proposal on behalf of Odell Peterson. He stated <br />40 units are already planned for the area and that this additional proposal <br />would merely add to the one already approved. Proposed roads into the area <br />were discussed. Mrs. Porter questioned the 16 foot driveway and sewer and <br />water locations. Mr. Falk requested information on adequate fire protection. <br />Fire Chief Fagestrom said he needs a 33 foot driveway and hydrants. Mayor <br />Rustad called for objections. Mrs. Joseph Everts objects. She wants area <br />to remain residential. Mr. Leroy Vale objects on the same basis. Mr. Francis <br />Wilcox objects, same basis. Mr. Swen Thelin objects, same basis. Mr. George <br />Porter objects, same basis. Mr. Bernard Falk objects, same basis. Mrs. Gene <br />Marti objects, same basis. Mr. Jerry Skelly objects, same basis. Mr. Vale <br />and Mr. Porter presented petitions against the rezoning. Mrs. Porter said <br />she was not notified by mail of the rezoning. The validity of the signatures <br />obtained on the abstract was questioned. Arthur Worcester present owner says <br />he is in favor. Arnold Peterson said the area is undeveloped at present. <br />Rezoning seemed the reasonable thing to do. Douglas Johnson says it is merely <br />an extension of previous rezoning. Mayor Rustad stated hearing was closed. <br />Councilman Johnson stated he objects. He said this would be general degradation <br />on single family residences. Councilman Malvin against. He said the people <br />were not told the facts. Councilman Lang against for same reason and because <br />the issue is confusing. Mayor Rustad against, encroaching on residential area. <br />Mayor Rustad then stated emphatically that Mounds View would be open to all <br />citizens, and that the Council would not tolerate threats about race, creed <br />or color. <br />MSP (Rustad /Johnson) To deny the rezoning. Rustad Aye, Johnson Aye, <br />Lang Aye, Malvin Aye. Rezoning denied. <br />Meeting adjourned for ten minutes at 9:40. Meeting reopened at 9:50. <br />Attorney Meyer's Report: <br />Mounds View named in complaint for condemnation for new super Trunk Highway #10. <br />8245 Edgewood Drive included in condemnation. Council decided not to condemn the <br />deserted house as was previously planned. <br />The Attorney reported the Village is receiving tax deed for the Lakeside Park <br />property. He asked the Council whether they would like a clear title. The <br />Council stated to leave as is. <br />Ron Fagestrom says he has no objection to an ordinance regarding incinerators. <br />MSP (Johnson /Malvin) Approve Ordinance #156 requiring incinerators for all <br />apartments and commercial establishments. <br />MSP (Malvin /Johnson) Approving Resolution #399, an agreement between Clarence <br />Smuder and the Village of Mounds View whereby Mr. Smuder agrees to be assessed <br />for sewer, water and street improvements in Smuder Addition. <br />4 Ayes F' <br />4 Ayes <br />
