November 13, 1978 Page 5 <br />Mr. Thorson stated that he believed the Council had previously said they would approve <br />the plat if he added on the 32', which would make the lots less than 1' short of the <br />required frontage. He pointed out that the lots are extremely deep, and square footage <br />wise were almost double of what was required. He added that he could take the extra <br />footage from the lot he had bought in order to make three 100' lots. <br />Councilmember Baumgartner replied that he did not recall the Council ever saying they <br />would definitely approve the plat with the 32' added on. <br />Administrator Achen stated that the best thing to do would be go back to the Planning <br />Commission with a redrawing of the preliminary plat since there is an obvious question <br />of what will happen with the additional lot. <br />Attorney Meyers asked if the title to the property had been transferred yet. Mr. Thorson <br />replied that it hadn't as he was waiting for Council approval before finalizing the <br />purchase of the additional lot. <br />Attorney Meyers asked if the additional 32' was included in the notice of the rezoning <br />hearing. Administrator Achen replied that it most likely had not. <br />Councilmember Rowley stated she felt the Planning Commission should address the request <br />again before the Council takes any action. <br />MSP (Pickar Ziebarth) to direct Dailey Knolls, Mr. Thorson, back to the Planning <br />Commission and direct that the Clerk- Administrator prepare a list for the Planning <br />Commission of the points they should take into consideration. 5 ayes <br />Councilmember Baumgartner asked if Mr. Gillman should be notified of that action. <br />Attorney Meyers replied that he would have to sign the application for the rezoning. <br />Mayor Pickar closed the public hearing and reopened the regular meeting. <br />WHITE OAK HOMEOWNERS ASSOCIATION SILT REMOVAL FROM PONDING AREA <br />Mayor Pickar reported that the White Oak Homeowners Association has initiated a request <br />to the Council to use Random Park as a temporary holding area for the silt from their <br />ponding area. He added that Staff and the Park Commission have reviewed the request <br />and recommend that the Silver View Park site would work out better than Random Park. <br />Tom Foster, president of the White Oak Homeowners Association, stated that he was still <br />in the process of having the DNR and Rice Creek Watershed District review the request <br />and that they have run into a problem with the Watershed District as the first meeting <br />they could consider the request is on December 2i, and that they had not anticipated <br />such a lengthy delay. He added that he was also concerned with the ice setting in on <br />the lake. Mr. Foster stated he had spoken to Roto Rooter, who would be doing the work <br />and that they would prefer waiting until Spring to do it, and that they had promised <br />this project would be first on their list for Spring. <br />Mayor Pickar asked if the delay until Spring would create any problems for the Homeowners <br />Association. Mr. Foster replied that it would not. <br />Councilmember Ziebarth stated that the primary concern of the Park Commission was to <br />accomodate the Homeowners Association, as Fall is a better time for this type of work <br />as it is dry. He added that they now have a suitable site but have a timing problem <br />with all the agencies involved. <br />
