Mr. Sunde stated that the planned size of the pond, had been submitted to the DNR and other agencies, but that he was willing to bring back a plan that places the pond totally within the perimeters of the development. Motion /Second: McCarty /Doty to amend the previous motion to accept the storm water drainage plan for Kraus /Anderson's development, contingent upon performance of the developer, as stated this evering. 5 ayes 0 nays Clerk /Administrator Pauley advised that Rice Creek Watershed District has asked to be included as a co- beneficiary of the bond. Attorney Meyers explained that he would be concerned that, in the event of any problems, Mounds View be completely protected and would benefit or collect first from the bond. Fred Haus, of Mary Anderson Homes, explained that they are already 80% completed with the pond, and that by the time the bond is pre- pared, they will be close to completely finished, and thus, it should not present any problem or danger to the City to have Rice Creek Watershed District added on as co- beneficiary. Mayor McCarty stated that he was they become involved in the pond not public improvements.
