Mounds View City Council November 22, 1982 <br />Regular Meeting Page .Five <br />Motion /Second: McCarty /Blanchard to direct Staff <br />to notify Dynamic Designers that upon payment of <br />all applicable fees, they can make application <br />to the Planning Commission for consideration of <br />their proposal, as it relates to ordinance No. 48. <br />4 ayes 0 nays <br />i4otion /Second: McCarty /Hodges to table action on <br />1 c item, per the recommendation of the Finance <br />Director. <br />4 ayes 0 nays <br />Mayor McCarty stated he has reservations with the <br />hold harmless agreement and questioned whether the <br />City is fully protected in the event of a lawsuit. <br />Attorney Karney stated there is no specification <br />of indemnification, and it is not clear that <br />defense costs on the part of the City would be <br />covered. <br />Motion /Second: McCarty /Forslund to table any <br />further action on the Golden Gloves Boxing Program <br />until the applicants present the City with a con- <br />tract of protection for litigation that is accepta- <br />ble to the City Attorney. <br />4 ayes 0 nays <br />Park and Recreation Director Anderson pointed out <br />the City's involvement in the program is minimal, <br />and the program has been very well received to date, <br />with 58 young men participating. He asked for <br />clarification from the Council on what specific <br />action should be taken until the contract is pre- <br />sented to the City and approved. It was the con- <br />sensus of the Council that Park Director Anderson <br />and Attorney Karney could sit down and reword the <br />contract and have it signed by the next day. <br />Director Johnson reported he had received a letter <br />from MnDOT regarding the MSA program. He stated <br />he is under pressure to complete the MSA study <br />for a five year construction program, by the end <br />of 1982. He added he will be working on it in <br />December, and that it will be flexible so that <br />the City can make changes later on. <br />Director Johnson questioned if there would be a <br />Motion Carried <br />15.
