Mounds View City Council April 11, 1983 <br />Regular Meeting Page Eight <br />Attorney Meyers reported that, after being <br />directed to review the actions of three Council <br />members relative to the use of the corporate name, <br />he could give a preliminary report relating to the <br />issues, but would have to wait until reading the <br />approved minutes to give a final finding. <br />Attorney Meyers reviewed the three motions that <br />had been made, as well as applicable laws and <br />court cases on similar matters. He summarized, <br />stating that the motion to protect the use of <br />the corporate name was proper, however, the <br />three Council members exercised their judgemental <br />ability in voting against the formal, rather than <br />informal, contact with the DFL Club, and no law <br />was broken, nor did anything illegal occur. <br />Mayor McCarty stated that at the March 28 meeting, <br />he had not heard the third motion clearly, and <br />thought the motion was for formal, rather than <br />informal, contact. He stated he favored formal <br />action as the Council has always enforced <br />ordinances consistently. <br />Motion /Second: McCarty /Doty that the notification <br />come from the City Attorney, and be formal, rather <br />than informal, in keeping with past practice in <br />enforcing the statutes and City ordinances. <br />No vote was taken. <br />There was considerable discussion among the Council, <br />with Councilmember Linke pointing out that no law <br />was broken, so the issue could be handled informally. <br />It was then questioned how they were to determine <br />in each instance if a law was broken, so communication <br />should be formal or informal. <br />Motion /Second: Hankner Linke to postpone until the <br />next agenda session, to allow time to seek counsel. <br />No vote was taken. <br />Motion /Second: McCarty /Dcty to amend the previous <br />motion to postpone to the next regularly scheduled <br />Council meeting rather than agenda session. <br />5 ayes 0 nays <br />Councilmember Doty reported he had attending the <br />hearing on House File 829, regarding the airport <br />and reviewed what had happened. <br />Councilmember Doty reported he has been asked <br />about getting left turn signals at the intersection <br />of Silver Lake Road and Highway 10, and asked for <br />a study, not formal, and a report from the Police <br />Department. <br />16.
