Mounds View City Council July 25, 1983 <br />Regular Meeting Page Five <br />Councilmember Linke asked, as per the agenda meeting, if <br />Director Johnson was guaranteeing completion of the <br />project by December 31, 1983, within the hours specified. <br />Director Johnson replied that he is estimating the work <br />will be completed by the number of hours specified, and <br />he would come back to the Council if it appears additional <br />hours would be required. <br />Councilmember Linke stated he would like an assurance that <br />the items will be finished by the end of the year, and he <br />wants to make sure the additional 481 hours will see to <br />that. He also stated that he would like to see the hours <br />set to be used as specified. Director Johnson replied <br />that he is pledging sufficient time to the City to <br />complete the projects. <br />Mayor McCarty clarified that the Council's stand is that <br />Director Johnson is guaranteeing to complete the projects <br />in the number of hours specified, and that if the Council <br />pulls him off a project to work on something else, <br />additional time would be allowed. <br />Attorney Meyers stated that the clause regarding termi- <br />nation by just cause would cover the situation if the <br />work was not completed, and the Council could terminate <br />the contract. He added that both parties should keep <br />the other aware of progress and if time is getting <br />tight. He also stated that if Mr. Johnson shou- exceed <br />the number of hours he specified for a project, in order <br />to complete it, the Courts most likely would au, rd him <br />payment for all time spent on it. <br />Motion /Second: McCarty /Linke to approve the addendum <br />to John Johnson's contract with the City of Mounds <br />View, as per his memo of July 25, 1983, with the hours <br />in items 3 and 4 to be changed around. <br />4 ayes 0 nays <br />Director Johnson stated he would correct Exhibit A to <br />have the hours coincide with those in his letter. <br />Director Johnson reported he had received a letter <br />from MnDOT, requesting the City's presence at a <br />meeting on August 15, in Mankato, to explain the <br />balance in the municipal aid account. He stated <br />that he plans to attend, with documentation. <br />Director Johnson reported he has been in contact with <br />representatives from the Highway Department, regarding <br />Highway 10, and that a public hearing will be rcheduied <br />,for this Fall, and they hope to have an environmental <br />impact study approved by the end of the year. He <br />added they would be meeting with Staff sometime in <br />August to update them, prior to the public hearing. <br />Motion Carried <br />12.
