Mounds View City Council July 25, 1983 Regular Meeting Page Five Councilmember Linke asked, as per the agenda meeting, if Director Johnson was guaranteeing completion of the project by December 31, 1983, within the hours specified. Director Johnson replied that he is estimating the work will be completed by the number of hours specified, and he would come back to the Council if it appears additional hours would be required. Councilmember Linke stated he would like an assurance that the items will be finished by the end of the year, and he wants to make sure the additional 481 hours will see to that. He also stated that he would like to see the hours set to be used as specified. Director Johnson replied that he is pledging sufficient time to the City to complete the projects. Mayor McCarty clarified that the Council's stand is that Director Johnson is guaranteeing to complete the projects in the number of hours specified, and that if the Council pulls him off a project to work on something else, additional time would be allowed. Attorney Meyers stated that the clause regarding termi- nation by just cause would cover the situation if the work was not completed, and the Council could terminate the contract. He added that both parties should keep the other aware of progress and if time is getting tight. He also stated that if Mr. Johnson shou- exceed the number of hours he specified for a project, in order to complete it, the Courts most likely would au, rd him payment for all time spent on it. Motion /Second: McCarty /Linke to approve the addendum to John Johnson's contract with the City of Mounds View, as per his memo of July 25, 1983, with the hours in items 3 and 4 to be changed around. 4 ayes 0 nays Director Johnson stated he would correct Exhibit A to have the hours coincide with those in his letter. Director Johnson reported he had received a letter from MnDOT, requesting the City's presence at a meeting on August 15, in Mankato, to explain the balance in the municipal aid account. He stated that he plans to attend, with documentation. Director Johnson reported he has been in contact with representatives from the Highway Department, regarding Highway 10, and that a public hearing will be rcheduied ,for this Fall, and they hope to have an environmental impact study approved by the end of the year. He added they would be meeting with Staff sometime in August to update them, prior to the public hearing. Motion Carried 12. Report of Director of Public Works/ Community Dvlp.
