He explained the restau- rant code does not require they be operational in order to be licensed. He stated they do have rest- aurant equipment and a permit from the Ramsey County Health Department. Motion /Second: McCarty /Doty to table the approval of the on -sale liquor license for Loose Ends On 10, pending an opinion from the City Attorney relative to the proper usage of that license in conjunction with the serving of food. 4 ayes 0 nays Motion /Second: McCarty /Doty to approve Item J, minus Loose Ends On 10, and waive the reading. 4 ayes Mayor McCarty closed the regular meeting and opened the first public hearing at 7:47 PM. Clerk /Administrator Pauley explained the property in question is presently operating as an import auto shop. Jim Vleck asked the intent of the rezoning. Mayor McCarty explained it is an effort on the part of the City to bring the zoning map and comprehensive plan into conformance, He added the Comprehensive Plan is not always consistent with the proposed rezoning. Peg Mountin, Chairman of the Planning Commission, stated the property located at 2848 Highway 10 is in compliance with the proposed land use map for medium density residential use. Ms. Schuldt questioned how this piece of property could be downzoned, when the City couldn't down zone Knollwood Green. Mayor McCarty explained Knollwood Green was already in compliance with the intended use and comprehensive plan. Mayor McCarty closed the public hearing and reopened the regular meeting at 7:50 PM. Motion /Second: McCarty /Doty to table the rezoning of 2846 Highway 10 until such time as the Planning Commission has the opportunity to readdress the rezoning. 4 ayes Motion Carried 0 nays Motion Carried 7A.
