Mounds View City Council July 14, 1986 <br />Regular Meeting Page Three <br />4 1 ttorney Meyers reviewed the stipulation and order <br />rom the second judicial district court, regarding <br />z.he City of Mounds View versus the Metropolitan <br />Council and the Metropolitan Airports Commission <br />He stated he understands MAC has approved the <br />settlement, and the Met Council has no objections <br />to it, and the matter is now being submitted to <br />the City Council. <br />Attorney Meyers clarified that the stipulation and <br />order relates only to Phases LA and 1B, and if the <br />stipulation is agreed to by the City, it would be <br />submitted to the District Court for approval. <br />Attorney Meyers read the stipulation. He asked that <br />if the Council approves it, they authorize him to <br />execute it on behalf of the City of Mounds View. <br />Councilmember Hankner stated that in past discussions <br />it had not been clear whether the removal and installa- <br />tion of the new runway would take place together. <br />Attorney Meyers clarified the 2,580 feet would be <br />removed first, then the additional 2,580 feet on the <br />north would be added. <br />Motion /Second: Hankner /Quick to accept the stipula- <br />ion and authorize the City Attorney to execute it <br />'n behalf of the City of Mounds View. <br />5 ayes 0 nays <br />Councilmember Hankner stated she feels MAC seems <br />sincere in following through with what has been <br />laid out in the stipulation, and while it has been <br />a real problem for residents on the north side of the <br />City, the moving of the runway should help considerably. <br />Mr. Frits stated he does not feel MAC will follow through, <br />as they have made promises before, but not kept them. <br />Mayor Linke explained that if they violate the stipulation, <br />they will be in default and the court will deal with them. <br />Councilmember Hankner stated she shares many of Mr. Frits's <br />concerns, but she feels confident the movement of the <br />runway to the north will help considerably. <br />Duane McCarty, 8060 Long Lake Road, Asked if the stipulation <br />applied to the 1985 Metro Developement Guide or 1980 Development <br />Guide. Attorney Meyers replied it applies to the 1985 <br />�tro Guide. <br />r. McCarty urged the Council to turn the stipulation <br />down, and he stated he was concerned with the weight <br />stipulations. <br />8. Consideration <br />of Proposed <br />Stipulation and <br />Order with MAC <br />Motion Carried <br />
