Mounds View City Council December 28, 1987 <br />Meeting Page Three <br />Planner Herman replied it would, with the existing <br />driveway being seeded over, and the new driveway <br />would face Fairchild. <br />Mayor Linke closed the public hearing and reopened <br />the regular meeting at 7:18 PM. <br />Clerk /Administrator Pauley explained the necessity <br />of the proposed ordinance, which would allow non- <br />peace officers to issue citations. He stated that <br />State law now requires municipalities to have such <br />an ordinance in order for non -peace officers to <br />issue citations. <br />Motion /Second: Quick /Hankner to have the first <br />reading of Ordinance No. 434, amending the Municipal <br />Code of Mounds View by amending Chapter 1.11, <br />entitled, "General Provisions of Code and waive <br />the reading. <br />4 ayes 1 nay <br />Councilmember Blanchard voted against the motion, <br />with there being considerable discussion on the <br />motion before the vote was taken. <br />Councilmember Blanchard stated she did not feel it <br />was necessary to have every department head in the <br />City able to write tickets, and she added with so <br />few being written, it should not be a hardship on <br />the Police Department to write them, as they are <br />trained to do so. <br />Mayor Linke stated he did not feel the Police <br />officers were trained to find things in violation <br />that a building inspector would, and that the <br />Police would not be that proficient in Court in <br />presenting evidence, as would the building <br />inspector who was familiar with the violation. <br />Councilmember Blanchard stated the Police are <br />trained to communicate with people, and she felt <br />if a case went to Court, the building inspector <br />would be there also to provide testimony. <br />Councilmember Quick pointed out that would he tying <br />up at least two Staff members then, in going to <br />Court. He stated he feels comfortable with the way <br />the ordinance is written, with specific people <br />assigned to their area of expertise. <br />Councilmember Blanchard stated she felt these were <br />Police powers, and should be left to the Police. <br />9.
