r- Pauley reported the City's 13. <br />JConsulting Engineer has recommended the release of the <br />development securities provided the City for Continental <br />Development Corporation, be released the work has been <br />completed and found to be acceptable. <br />Mounds View City Council May 9, 1988 <br />Regular Meeting Page Seven <br />Motion /Second: Hankner /Quick to approve the release <br />of development security to Continental Development <br />Corporation of Irrevocable Letter of Credit #3929 from <br />Builders Development and Finance. <br />5 ayes 0 nays <br />Clerk /Administrator Pauley recommended the Council <br />direct Staff to prepare a resolution, listing the <br />specific issues they would like addressed, and then <br />consider the resolution at the May 23 meeting. <br />Motion /Second: Hankner /Wuori to direct Staff to <br />prepare a resolution to deny the variance request <br />appeal of Dynamic Designers for 7656 and 7660 Woodlawn <br />based in part on the lot size, phospherous stripping <br />capacity, storm water run -off, flood height, and any <br />further findings that would have an adverse effect <br />on the wetland. <br />5 ayes 0 nays <br />Mayor Linke pointed out the Council would not be <br />denying the developer the use of his land, as there <br />is another way it could be utilized which would allow <br />him the use of the property. He stated that could be <br />accomplished by putting up a smaller building, which <br />would require less parking. He added the developer <br />has not shown that this is a unique situation. <br />Councilmember Hankner stated that if development is <br />to occur on that site, it would have to meet the <br />criteria established by the ordinance. <br />Clerk /Administrator Pauley read proposed Resolution <br />No. 2322. <br />Motion /Second: Hankner /Linke to approve Resolution <br />No. 2322, with an amendment in the third whereas, <br />to state "adult themed objecting to the programming <br />of adult themed movies on North Central Cable Company's <br />Channel 34 and requesting removal of adult programming <br />from the cable system. <br />'4,../5 ayes 0 nays <br />Authorize <br />Release of <br />Development <br />Security to <br />Continental <br />Development <br />Corporation <br />Motion Carried <br />14.
