Consideration of Adoption of Ordinance No. 567, Amending Chapter 202 of the Municipal Code, <br />Entitled, "Public Improvements". <br />Mike Ulrich, Director of Public Works explained that at the September 26, 1995 Council meeting, a <br />public hearing was held to introduce proposed amendments to Chapter 202 of the Municipal Code <br />Entitled "Public Improvements". He proceeded to address these changes. <br />Mr. Ulrich noted that this was the second and final reading of the ordinance. <br />Ms. Trade stated she would like to see the changes publicized in the next city newsletter. <br />MOTION/SECOND: Quick/Blanchard to approve the Adoption of Ordinance No. 567, Amending <br />Chapter 202 of the Municipal Code, Entitled, "Public Improvements". <br />ROLL CALL: Mayor Linke yes <br />Council member Blanchard yes <br />Council member Trude yes <br />Council member Quick yes <br />- Motion Carried - <br />Mr. Ulrich noted that the introduction of Ordinance 560, which was the document entitled, Public <br />Improvement Assessment Policy, should also be denied at this time. <br />MOTION/SECOND: .Trude/Blanchard to deny Ordinance 560, which was the previously introduced <br />assessment policy in June. <br />VOTE: 4 ayes 0 nays Motion Carried <br />C. Consideration of Joint Powers Agreement, Mounds View/New Brighton/Dynex Industries. <br />Paul Harrington, Commututy Development Coordinator explained that in the Spring of 1995, Dynex <br />Industries was given approval for development review for expansion of their facilities at 4851 Mustang <br />Drive. As part of the review process, staff submits their plans to the Mounds View Police Department <br />and the Mounds View Fire Department for review and comment. The Mounds View Fire Department <br />asked that a fire suppression hydrant be put in on the south side of their property. The only availability <br />of water on the south side of their property was off into the New Brighton water main. This <br />necessitated the Joint Powers Agreement between the cities of Mounds View and New Brighton. An <br />agreement has been drafted which is acceptable to both cities. He noted that this has been reviewed <br />by the city's attorney as well. The City of Mounds View will be listed as the responsible party as far <br />as maintenance, installation and charges for water. Brian Sjoberg of Dynex Industries has been <br />contacted and informed that a supplemental agreement would need to be entered into between Mounds <br />View and Dynex should the council approve the Joint Powers Agreement, transferring those <br />responsibilities and liabilities to Dynex. <br /> <br />
